广西钦州市浦北县男子庞宗祥无端卷入北海系列摩托车抢劫并致人死亡案，两次被判死缓，直至今年11月22日案件撤诉重获自由。24日，他与南都记者长聊一个多小时，称被耽误了的青春，遭遇的非人折磨，是他6年中最难忘的经历。
谈取保若非中央出政策应会关下去
南都：6年后父母见到你，是什么反应？
庞宗祥(以下简称庞)：我被判死缓后，父亲病倒在床上一直没有起来，母亲也病得很严重。但昨天听到我要回来，父亲还是爬起来到门口接我，我们抱头痛哭。
南都：你周边的人怎么看待你的事？
庞：也有个别跟我有点恩怨的人说闲话，但我平时乐于去帮助别人。我老婆都骂我，说又没什么好处怎么自己的事还没干先去帮人家。村里人也说以前庞宗祥在外面从没犯过事，进去后，他们也不相信我是犯法的人，他们都说，今天我终于出来，说明中央政策逐步实施到位。回来时，一些亲朋好友在十几公里外就接我，并一路拍下我回家的视频，说要留下做个见证。
南都：你觉得，能重获自由跟中央政策相关？
庞：应该是这样，如果不是中央一些政策出台，应该会继续关下去。北海司法机关不可能承认自己办错案，但也不敢放我，一直就在来回犹豫，放不知道怎么放，判不知道怎么判，正在骑虎难下时。中央政策来了，就放了。
南都：感觉失去最多的是什么？对人生有什么计划和安排？
庞：失去最多的是6年的青春就这样被耽误浪费，特别在亲情上，无法照顾父母，儿子也因为我的事情，上完初中就失学，为了跑我的事，家里也欠了很多债，自己现在身体也差，需要一段时间调养，身体恢复后，还要继续想办法去讨生活。
南都：你会申请国家赔偿吗？另外，案件结案后，如果最后无罪，是否会追究相关人员的责任？
庞：我现在还只是被取保候审，一年后应该有结论，申请国家赔偿是应有的权利，肯定会跟律师商量，包括追究那些制造冤假错案的人的责任，我对法律东西不太懂，会和律师去商量。
谈审讯录像里的人，根本不是我
南都：还记得被抓那一刻的场景吗？
庞：当时我在广东廉江的工地上搞装饰，和沙浆铺地面砖，不清楚警察怎么找到我。湛江的警察拍了我一下，问：你是不是广西的，有人在网上通缉你。让我先到廉江公安局，说广西公安有人找我。我说又没犯罪找我干什么？他们说，犯罪与否与他们无关，等下他们(北海公安)会来接你回家。
南都：被从廉江抓走后去了哪里？听律师讲在公安局里待了3天，并没有送去看守所，在公安局里遭遇了什么？
庞：遭到刑讯逼供，用手摇电话机电击我两天两夜，现在我的脚都比抓去前大了1/3.
南都：开庭时有就刑讯方面进行审查吗？
庞：广西高院开庭时审了，有两个办案人员出庭，他们拿出录像说没有刑讯，但录像里的人只是跟我长得有点像，根本不是我，而且刑讯时我穿的蓝色衣服，而录像里的人穿的白色衣服。我要求重新鉴定录像带，后来也没给我结果。
南都：你什么时候知道，被卷入到摩托车司机被抢劫的案子里？
庞：警察一开始也没对我讲，他们问我，知道为什么找你？我说不知道，他们又说，有人说你在北海干了好多坏事，我说我在北海从不干坏事，吃饱了饭做工，做完工喝点酒睡觉。况且案发时我夫妻刚好不在北海，有证人证明，我根本没有作案时间。
南都：警察如何判定你涉案？你后来怎么认了？
庞：他们开始没有跟我说是什么案？也没说犯案的时间，只说几月份，在哪里抢劫？我说没抢但我受不了折磨，为了保命，就说你们写好材料我签字，别再逼我折磨我。口供根本就不是我本人说的。(2007年)8月11日，又拉我到犯案现场让我指认，我没犯案怎么知道指哪里，就随便乱指一下，他们说不是，说往那边指。哪里有这样办案的？
南都：后来怎么翻供的？
庞：到了检察院我就翻供了，但又被他们拉回去电击。还是为了保命，我又承认了。
谈判决听到死缓腿软站不稳笔拿不稳
南都：还记得第一次开庭时的情景吗？在庭审中说了些什么？
庞：开庭时，王勋(盗窃疑犯)说我是28岁。我都38岁了，足足大了十岁，真不知道怎么就认定是我了。
南都：第一次听到自己被判死缓时有何反应？
庞：听到判决我当时懵了，腿也软了根本站不稳，叫我签字时笔都拿不稳。
南都：上诉到高院被发回重审，看到希望了吗？后来再次被判死缓，怎么想？
庞：我很佩服广西高院，两次发回重审，他们做了正确的裁定，对再次被判死缓，我非常不理解，为什么广西高院都说事实不清证据不足，还要判我死刑？
南都：收到撤案裁定那天是什么场景？
庞：那天下午我正在看守所里，管教叫我说提审，北海市检察院来的人给我一张法院的撤诉裁定，说你的家人在外面等你，后来公安来办取保候审手续，给我交代了一些要注意的事项，当时还让我填一个身体状况表格，本来我身体有病，但在上面五项全部写了“无”，就想着尽快出去，免得节外生枝。
南都：出来后见到亲人有什么感受？
庞：我走出看守所已经6点多，天已经黑了，几个弟弟在外面，大家抱在一起都哭了起来。听我弟弟讲，检察院只跟他们说会见，没说放人，回来后村里人也说，北海为什么要在晚上放，到底有什么见不得光？我现在仍然不明白，既然已经裁定撤销起诉，案子已经与我无关，为什么还要取保，应该无罪释放。
南都：无端被卷进案子里，两次被判死缓，现在终于又重获自由，怎么看待自己的这段经历？
庞：现在思想很复杂，也不知道说什么。国家是在向好的方向发展，上面的政策也是对的，但像北海这样上有政策、下有对策，老百姓的权利怎么保证？南都记者张国栋
