11月13日晨，一场夜雨后的弋阳县城，笼罩在湿漉漉的雾气里。以江桥为界，近14万人口的县城分为新老两块。陈文云的双汇冷鲜肉店就位于老城区的广场路。
退伍军人陈文云今年24岁，他的双汇冷鲜肉店今年9月25日开业。10月3日凌晨5点，店面遭到当地猪肉批发户陈礼林、时献忠等人的打砸，店员方有明遭到殴打。冲突中，方有明持刀刺伤陈礼林和时献忠。事后，陈礼林、时献忠、方有明等4人被拘留。
时隔一个多月，提起店被打砸，陈文云还是很激动。在他看来，打砸事件并非偶然发生。
开业9天，送货车被拦5次，有关部门6查小店——
店主的遭遇是否偶然？
陈文云说，自店面开张，9天之内，双汇的送货车被拦了5次，分别发生在9月26日、27日、28日和10月2日、3日。带头拦车的正是陈礼林和时献忠。
与此同时，县内贸办、动物检验检疫、工商、药监、公安等部门前来检查过6次。陈文云说：“6次执法检查都是叶金华带着来的。感觉不是来执法的，而是故意找事儿。”
陈文云回忆，9月中旬，店里还在装修，县内贸办主任科员叶金华就找过来，要求他向县里备案。按照规定，陈文云已经办理开店必须的手续，包括税务登记证、个体工商户营业执照等。为了能顺利开店，他还是把一份报告交到县内贸办。
这之后，9月28日到10月2日，叶金华每天都带着联合执法队到店里检查，每次都提出新要求，比如提供食品流通许可证、台账要登记每个顾客的详细信息等。然而，工商部门告诉陈文云，食品流通许可证主要针对包装食品，出售肉类无需办理。
每次送货车被拦，陈文云都报了警，一共5次。“刚开始警察管，145号文件出来后，警察说不能认定我的店是合法的，就没有对拦车的人采取措施。”陈文云说，拦车的屠宰户手里也有145号文件，他们主动向警察出示了这份文件。

弋阳的解释是否牵强？
叶金华要求陈文云提供“食品流通许可证”的依据，也是弋阳县人民政府办公室印发的“145号文件”。
记者辗转拿到这份印发于9月26日的弋府办字【2013】145号文件：《关于进一步加强全县猪肉类产品市场监督管理工作的通知》。文件称，要“实行外埠冷鲜猪肉白条肉等猪肉类产品市场准入制度”，“凡符合国家规定标准的冷鲜肉进入我县区域销售，经营者应向县内贸办备案，并提供冷鲜肉生产企业的屠宰许可证、食品流通许可证、动物防疫许可证、肉品检验合格证等相关证照复印件和区域销售协议，以及国家认证的安全无公害肉品的认证文件”。
这份文件在陈文云的双汇店开业的第二天印发。9月28日凌晨，叶金华持文件对该店进行了检查。
“既然是县里新出的文件，为什么只单单检查我这一个店呢？”陈文云想不明白。周边商户也证实，几次检查，联合执法队都是直接到双汇店，并没有检查对面农贸市场的猪肉批发户。
而知情人透露，145号文件的起草者正是叶金华。
弋阳县内贸办主任胡长剑告诉记者，这份文件确实是内贸办起草的，当时考虑到中秋、国庆节即将来临，为的是确保节日肉类市场食品安全。不过，今年中秋节是9月19日，文件出台时，中秋节已经过去。
记者问胡长剑：“这份文件出台之前，依据什么管理？”
胡长剑：“国务院2008年的《生猪屠宰管理条例》。”
记者：“那这5年间，市场上出过什么问题吗？”
胡长剑：“没有。”
记者：“为什么今年要专门出台这样一个文件呢？”
胡长剑：“加强食品安全监管吧。”
记者：“国务院《生猪屠宰管理条例》明确指出，不得限制外地生猪产品进入本地市场。为何时隔5年之后，要突然出台一份与国家规定不符的文件呢？”
胡长剑：“145号文件有些规定，确实与国家规定相违背，主要是我们学习不够吧。”
弋阳县政府的一位领导称，145号文件有些规定只是“语言措辞不当，引起误会”。
中国政法大学行政法研究所所长张树义指出，145号文件出台的过程涉嫌违背相关程序。“程序本身就是为了避免轻率出台文件，不能一个部门，甚至是一个人想出什么文件就出什么文件，这违背了立法精神，涉嫌利用政府职权谋取私利、打击报复。”
县内贸办主任科员承包生猪屠宰场——
违规经商系因“学习不够”？
叶金华为何“针对”陈文云？采访中，当地不少群众告诉记者，叶金华是弋阳县生猪定点屠宰场的承包人，双汇店开张后，屠宰场的屠宰量有所下降，当地猪肉定价也受到影响。
知情人士透露，曾有人向县里反映过叶金华的承包违反规定，没有公开招投标，而且承包费用明显偏低。但是，反映没有结果。
此外，据知情人士透露，叶金华承包的屠宰场还存在其他管理问题，比如，2012年10月起，国家免征猪肉产品流通环节增值税，但弋阳县屠宰场直到2013年1月还在收取，多收的税款到10月下旬才退还；还有人指称屠宰场做假冒领生猪无害化处理补贴、瞒报屠宰生猪头数以逃税等嫌疑。
对第一个问题，县内贸办解释说，国税部门没有及时通知，存在信息滞后问题，多收的税款从国库退回也需要一段时间。记者为核实另两个问题，提出查看屠宰场相关台账，没有得到回应。
弋阳县有关领导均承认，叶金华承包屠宰场违反国家相关规定，但均表示此前对叶金华承包一事毫不知情。
据胡长剑介绍，叶金华从2012年起承包弋阳县生猪定点屠宰场，每年承包费16万元，合同签订10年，前3年承包费48万元以现金形式一次性交齐。“当时这是内贸办中层以上领导共同开会决定的，主要是考虑到叶金华本人分管这项工作，有管理经验。”胡长剑说。
“公务员经商不违反规定吗？”记者问。
“现在看来，这个决定是错误的，主要是学习不够。”
中南财经政法大学廉政研究院教授乔新生认为，公务员从事商业经营活动，违反了政企分开的原则，是典型的违法行为。对这种行为，应当依据我国《公务员法》及其配套性法规作出严肃处理。如果执法不严，知情不报，那么，当地有关负责人应当承担行政责任。
当地依然持“经营户普通纠纷”观点——
政府究竟该如何面对市场竞争？
双汇店被砸事件发生已近两月，记者在弋阳采访时，不止一位县领导认为，这属于“一起经营户之间普通的纠纷”。弋江派出所负责人表示，该案目前还没有涉及叶金华，拦车和砸店之间的关系还在查，目前没有并案处理。
城北农贸市场一名摊主告诉记者，双汇肉店开业，对他的生意影响蛮大的。“以前每天卖两条猪，现在只能卖一条。而且，双汇进来以后，零售价已经降了一块钱。”陈文云现在每天卖400斤左右的白条肉，虽然数量不算多，却也在一定程度上影响了当地肉价。
参与打砸的时献忠在当地卖了30年猪肉，他说：“主要是小陈卖的白条肉太便宜了。以前过节我们可以涨价，多赚点钱，现在不行了。”他还担心陈文云以后还会开分店。
不过，消费者的反应显得更理性平和。有人认为有品牌的肉便宜放心，自己多了一个选择；有人说习惯吃土猪肉，还是会到农贸市场的摊位去买。一家饺子店的老板娘说：“就像我卖饺子，别人也卖饺子，我总不能去堵别家饺子店的门吧，只能把自己的事做好，饺子好吃生意才好嘛。”
中国人民大学农业与农村发展学院教授张利庠认为，弋阳双汇冷鲜肉店被砸不是个偶然事件，实际上反映了地缘经济和市场经济体系之间，传统生猪销售业态和现代业态之间，地方中小养殖户、屠宰场和大企业之间的矛盾。这些矛盾是共性问题，有可能将来在全国其他地方也会出现。
专家指出，面对新的市场变化，政府部门有比出台限制政策更多的事可做。
张利庠分析，本地小商贩经营的肉摊在解决就业、满足本地消费习惯方面有不可替代的作用。双汇的进入对他们而言确实是冲击，但政府应该相信市场的调节作用。政府的职责应是规范市场秩序。无论是大企业还是小商贩，都要从源头把关，确保其产品质量。另外，物价部门要做好监测，既要避免本地商贩随意涨价，也要防范大企业低价倾销破坏市场秩序。同时，引导本地屠宰户提高卫生意识、产品质量，经营土猪等特色农产品，在市场竞争中发挥自身优势。
采访中，时献忠提出对政府管理和服务的期望：“希望县屠宰场的屠宰服务费能再低一点，浙江那边只要30多块，这样我们还有钱赚。”
双汇店被砸事件的处理和对叶金华的立案调查还在进行中，未解的疑问，相信会有公开公正的结果。
这起纠纷不普通
