“2008年4月、5月，被告人王伟从蒋新卫(已判刑)处接管部分赌博游戏厅进行赌博活动。同时王伟注册成立了陕西伟一实业有限公司，该公司经工商部门核准的经营范围为房地产开发、销售；建筑材料、钢材、装饰装修材料等。为牟取非法利益，该公司超出核准经营范围专门经营电子赌博游戏厅……”因案情复杂，审判长宣读判决书就用了近两个小时。
宣判同时，西安中院官方微博进行了微博直播，在两个小时里发图文微博201条。同时，还通过西安中院官网及光明网、华商网等对宣判进行网络视频直播。
定期开会 招人强调“三防”

一审认定为黑社会性质组织
8月27日的庭审中，被告人王伟只承认开设赌场罪，对其他罪名均予以否认。法庭调查认为，王伟等30余名被告人已经形成了黑社会性质组织。最终，西安中院以被告人王伟犯组织、领导黑社会性质组织罪、开设赌场罪等6项罪名，数罪并罚决定执行有期徒刑15年，并处没收个人财产“普拉多”一辆、人民币85万元，其他33名被告人中有30人涉及罪名包括“参加黑社会性质组织罪”，另有三人因“开设赌场罪”获刑或免予刑事处罚。宣读完毕后，大多数被告人表示将上诉或再考虑。
在被带离法庭时，有几名被告人大声叮嘱旁听席上的父母，“保重身体啊！”听到儿子的呼唤，几位头发花白的老人伏在椅子靠背上泣不成声……

2008年4月，王伟注册成立陕西伟一实业有限公司，任法人代表，工商核准经营范围为房地产开发，建筑材料、日用百货等销售。为牟取非法利益，该公司超范围经营电子赌博游戏厅，王伟纠集其他被告人协助其管理公司，以开设赌场为主要获利手段，有组织地实施了一系列违法犯罪活动，逐步形成了以被告人王伟为首的人数众多、组织领导明确、骨干成员基本固定的黑社会性质组织。
2008年至2011年期间内，该组织先后在西安市雁塔、长安、灞桥、碑林、莲湖、未央、新城、高新、蓝田县及咸阳市大量开设电子赌博游戏厅，获取非法利益，为了其赌博游戏厅的开设和顺利经营，多次实施故意伤害、强迫交易、聚众斗殴、妨害公务等违法犯罪活动。

开设赌场罪
——开电子赌博游戏厅26家，非法经营额达1.2亿元
2008年至2011年，该组织先后在西安多个区县及咸阳市开电子赌博游戏厅26家，其中部分赌博游戏厅是由被告人李某、赵某以及王某(另案处理)出资与该组织合伙经营。
该组织开设的赌博游戏厅由伟一公司出资、管理。王伟作为公司股东、法人代表，对赌博游戏厅的开设和经营有绝对的决定权和管理权。这几年，该组织经营赌博游戏厅非法经营额达1.2亿元。案发后，公安机关在该组织经营的多家赌博游戏厅及仓库内共扣押游戏机1675台，包括：八面动物乐园机、六面动物乐园机、棋王连线机等，经鉴定其中1662台具有赌博功能。

故意伤害罪
——报复他人，将多人砍伤
2008年8月，李某在莲湖区纸坊村伟一公司开设的“新天地”电玩城内赌博，输掉万余元。李某及其妻要求电玩城退还赌资，遭拒绝，遂向公安机关电话举报，同时向媒体曝光，导致该电玩城经营受阻。
为此，时任伟一公司外围部主管的席某纠集王某等人预谋报复。2008年9月10日零时，席某、王某、耿某等三人头套丝袜，手持砍刀、手电筒闯入李某家中，将熟睡的李某砍伤后逃离现场。法医鉴定李某为轻伤。
2009年12月17日凌晨，张某酒后到王寺西街伟一公司开设的“金蛋壳”游戏厅内滋事，先后与游戏厅经理程某及程的司机发生口角并厮打，张某头部被重击，右腿被刺三刀，不省人事后被抬出游戏厅，程某等逃离现场。法医鉴定：张某颅脑损伤程度属重伤。案发后，伟一公司人事部主管多次为张某汇入住院医疗费，并协调赔偿20万元。

强迫交易罪
——强锁超市大门，逼迫店主低价转让
伟一公司在西安市徐家庄村开设一赌博游戏厅未临街面，王伟看中该村北口一超市的位置，多次要求吴某转让，因超市经营状况良好，吴某拒绝转让。2008年6月，王伟找人假扮房东，借口房屋有质量问题，欲将吴某赶走。
同年7月一天，席某等多人来到超市店内，对吴某夫妇进行威胁，强行锁住超市大门。吴某被迫无奈以5万元低价将店面出让。
2009年9月，为开设新赌博游戏厅，王伟看中西影路观音庙村口位置，由王某等出面租赁房屋。同年9月8日，王某等与在此经营“湖南米粉店”的彭某达成7万元转让店铺协议，当日支付了1万元定金，次日支付6万元余款。
次日晚，王某等组织人员对米粉店内进行装修，王伟也来到现场，以价钱过高为由指挥手下强行拉走店内物品。当晚，房东徐某拉下电闸阻拦装修，向彭某之妻收取12000元转让手续费，王某等以转让受阻为由，逼迫彭妻返还7万元转让费，又殴打彭某。彭妻拿出仅剩的5万元，并写下2万元欠条。事后，彭某夫妇离开西安，返回湖南老家。“湖南米粉店”被王伟等人强行租下。
用类似方式，该组织又强占“湖南米粉店”隔壁的“蜀南竹签烤肉”店，打伤店主委托人，将该店开设成新赌博游戏厅。

聚众斗殴罪
——纠集数十人携带枪支、砍刀发生械斗
2009年1月26日下午，长安区引镇村民曾某酒后到引镇街道伟一公司开设的“鸿翔动漫城”滋事，殴打游戏厅副经理耿某，并砸坏游戏厅大门门头和游戏机，之后席某等接公司通知前往查看处理，席某等纠集数十人携带枪支、砍刀、洋镐把等赶到动漫城集结。
当晚，曾某与其父母及部分引镇村民持农械来到动漫城，双方发生械斗。其间，动漫城一方在追撵村民过程中将隔壁旅社的部分财物砸损。公安机关处警后，涉案人员逃离。之后，王伟带人赶到引镇，在雁翔路一加油站附近，听取手下汇报，又到引镇街道寻找曾某未果。案发后，赵某以动漫城经理名义出面接受警方处理。
