最高法12月4日审理腾讯诉360不正当竞争案

央视今日以“360诉腾讯垄断案开审，聚焦五大争议焦点”关注3Q大战。除了今天的庭审外，最高法院明天还会继续进行“3Q大战”一案的二审工作。

另外据央视报道，腾讯方面起诉360不正当竞争的相关案件则计划在12月4日在最高法院来进行开庭审理。

就奇虎360上诉腾讯滥用市场支配地位一案，合议庭认为本案在二审期间的争议焦点可以主要归结为如下五个方面，涉及22个具体问题。

1、如何界定本案相关市场？

2、本案被上诉人是否具有市场支配地位？

3、被上诉人是否构成反垄断法所禁止的滥用市场支配地位行为？

4、本案中的民事责任如何承担？

5、一审法院是否程序违法？
