合同工临时工不允许执法
近年来，公安、城管等执法部门出现多起暴力执法，甚至造成人员死亡的恶性事件，受到舆论高度关注。
有基层城管执法人员也称，受编制数影响，目前在城管等行政执法任务较重的部门，仍聘有较多“协管员”。按要求，协管员负责协助行政执法人员发现情况、口头制止纠正、配合执法取证等，不具有单独执法和处罚权力，但实际操作中，仍存在部分协管员“越界”和“越权”现象。
袁曙宏在文中指出，各级政府和有关部门将对全国行政执法人员进行全面清理，未取得执法资格的人员不得从事执法工作，对被聘用履行行政执法职责的合同工、临时工，应坚决调离行政执法岗位。
组建集中统一的行政执法机构

袁曙宏还指出，需加强财政对执法经费的保障，并严禁下达或变相下达罚没指标，严格执行罚缴分离，“对下达或者变相下达罚没指标、违反罚缴分离规定以及将行政事业性收费、罚没收入与行政执法机关业务经费、工作人员福利待遇挂钩的，要依法对直接负责的主管人员和其他直接责任人给予处分”。

穗现有五六千城管协管员
均无行政执法权
已颁布规范防止其越权

“比如在对小贩执法时，只有正式队员能出具文书、暂扣工具，协管员只是前期劝导和维持现场秩序等”，广州市城管执法局相关人士透露，协管员越权的行为在广州极为罕见，如有也只是极个别情况。
值得注意的是，今年以来，广州市城管与小贩发生数起冲突，当事人主要是协管员，冲突也常发生在劝阻阶段。此前，有城管执法部门负责人表示，劝阻并不属于行政处罚和强制范畴，但是实际执法前常常要经过这一环节。之所以出现问题，与协管员素质、工作手法及小贩态度有关。
今年发生数起冲突之后，广州城管执法部门已于今年10月颁布《广州市城市管理综合执法工作规范》，对城管执法正式队员和协管员的工作进行规范，尤其在文明用语方面，以期通过规范用语减少冲突事件的发生。
