“这个地方每天晚上人很多的，一挖就是一晚上，挖了好久了。”前天，杭州市民蒋女士给本报96068热线打来电话，她说这个建筑工地上有很多人在挖宝，还有人挖出了不少宝贝，听说值很多钱。
蒋女士担心的是，如果真是宝物，这些就该归国家所有，不应该就这么被人随意挖走。
根据蒋女士提供的线索，记者于前天晚上零点左右顺利找到了这个工地。
围墙外的马路上行人不多，喧嚣的城市已经开始渐渐平静。

走过多根混凝土底层圈梁，再顺着湿滑的泥土下行六七米就是他们的挖宝地——这里应当是地下一层的施工工地，约七八百平方米的施工面上堆着高低不等的泥土并造成了1~8米左右的落差。一束灯光就是一个人，五六个人分布在不同的地方单独挖着，声响很小，彼此之间也没有交谈声。
随着夜幕深沉，越来越多的人通过记者头顶的圈梁并下到这个“致富工作平台”上来。“这是南宋的，没有什么价值，最多只能卖一两块钱。”“这个黑陶还不错吧，年纪是很老了，工艺差一些，如果你要，1000元拿走。”
晚11点半，这个工地上至少有30人在挥锄挖宝，不少人已经小有收获；到次日零点半，工地上的人数暴增至80~90人，这时的工地上已经是头灯一片了；昨天凌晨1点半左右记者离开时，挖宝人达到近100人，几乎每个人的布袋里都已经装了些瓷器、瓷片。
他们基本都是职业挖宝人
挖到的多是些瓷器碎片
黑的是土，白的是瓷片，随便踢一脚，随手翻一块土都能找到一两片大小不等的瓷片。顺着土层断面从上往下看，能清楚地找到各个年代不同风格的瓷片，但经过一两千年的挤压，绝大部分瓷器都已经被压碎。
“哎呦，碎了，碎了。”一声惊呼下引来了不少围观人，一件被断代为北宋龙泉窑的葵口碗瞬间变成了瓷片。
挖宝人姓杨，他是个体户，他找到的这个断面可能是当晚最好的风水宝地。“可惜了，这里的土被压得太实了，混凝土一样硬，不然今晚我就可以有大收获了。”他说自己在这个工地挖了已经近1个半月，他看到的出土完整器已经超过十件，包括越窑碗、龙泉盆、碟和素烧观音。
这个工地上的近百号人都是专业在工地淘挖瓷片的，来自江西、安徽和河南，有条件的会三五人组成一组，获利后也是集体平分；单个掘宝的，自己既是打工者又是老板，一年能碰到一件品质较好的完整瓷器就足够了。
25日夜、26日晨的几个小时内，记者看到挖出的完整器少之又少，除了一个黑陶罐外就是一个拳头大小的类似“龙首”的龙泉青瓷笔搁。
至于小杨那个挖碎的葵口碗，不停有人围来讨价还价，从最开始的1500元出价，到最后的1.2万元成交，买的和卖的同时走出工地，带走了还留在工地上所有人的羡慕目光。
挖到宝的人走了，没有挖到的却因为被挖走的宝贝而更加兴奋。几乎每一个人都相信，说不定哪一锄下去就会露出某件完整器的一角：胎质紧密、造型规整、釉色肥厚油润……
考古部门将专人驻点
若发现精品会要求施工方停工
神秘施工工地挖出大量瓷片等出土器物，引得周边市民关注，也引起了杭州市文保部门的重视。
昨天下午，杭州市文物考古研究所考古一室王征宇主任和其他考古专家一同赶到文物出土地调查，现场鉴定了部分出土文物，并与施工方一起商讨了下一步的保护方案。
王主任介绍，经过考古所专家的现场查看与分析，初步判断该建筑工地在南宋时应该处在古临安城外围，不属于民众聚居地，但是宋以后这个地方肯定是有人居住的。在泥土中发现的碎瓷片等器物，主要是各个朝代遗留下的地层堆积物，时代跨度比较大，从宋到民国都有。出土的瓷片以浙江本地产的龙泉窑青瓷为主，也有部分景德镇产的青花瓷。“现场局部探挖得到的瓷片均为民窑，是民众日常所用的碗、盆、壶、罐等的残片，没有发现完整器。”王主任认为该探访发现完整瓷器的可能性比较小。
“这些瓷器，通俗点说来，就是老百姓平时用的碗盆破碎后，被随便堆埋于此的，所以出土完整器的概率很小。就算有，估计是一些档次不高的瓷器。”王主任解释说。总体上来看，这批文物的考古价值和收藏价值都不会太高，但出土量还是比较大，瓷片的密集度较高——如果放在大杭州工地考古的面上来看，和过往的发掘比较，这里出土瓷片量属于中上等水平。“以前杭州的工地里也发现过有遗迹动向，出土过重要文物，但是最近发现文物的工地数量不多。”
不过，文物考古部门依然十分重视施工工地内的挖宝情况。虽然出土的只是一些一般性文物，工地所在地也没有明显遗迹动向，但毕竟是出土文物，同样记录了历史的变迁，具有重要的考古价值。
所以考古研究所的专家们仍然会像对待重要文物一样，对这些器物予以重视。王主任说，接下来，考古所会派业务人员在工地驻点，并寻求建设单位配合，将出土的瓷器统一收集，放进考古所的库房中妥善保存。
“一旦发现精品，我们会和施工方进行沟通，必要的时候会要求他们停工。发现的精品器物也会做成图录，定期给市民进行展览。”王主任说。
盗挖瓷片情节严重者
会被追究刑事责任
近年来，杭州多个建筑工地相继发现过唐宋元明清等朝代的瓷器瓷片，其中不少工地被职业挖宝人盗挖盗采。事实上，这种行为存在极大法律风险。
浙江君安世纪律师事务所梅宁律师说，《中华人民共和国文物保护法》规定：中华人民共和国境内地下、内水和领海中遗存的一切文物，属于国家所有。在古城区拆迁改造过程中，出土的文物都应归国家所有，任何人都不能侵占和擅自处理，严禁私自挖掘、盗窃、哄抢、私分或者非法侵占国有地下文物的违法行为。
“擅自挖掘地下文物的行为触犯了法律法规，情节严重者会被追究刑事责任。”他说，表面上是盗挖瓷片，但实际上很可能会破坏古文化遗址，使得这些文物遭到不可逆转性破坏。另一方面，收藏这些瓷片也可能会面临处罚。
“既然文物法规定出土文物不得私自占有，那么购买并收藏这些瓷片就是收购赃物的一种表现，是违法的。”梅宁认为，因为地下文物走私、买卖仍有市场，盗掘、拼复、买卖产业链尚未割断，所以在从严惩处的基础上，还要加大宣传力度，形成保护文物的全民意识；建立完善遗址及周边地区治安管理长效机制，加强安保措施，增强治安巡逻，消除隐患，堵塞漏洞。他同时也呼吁类似文化遗存地的附近居民应提高警惕，一旦发现异常情况要及时报告，防止再发生盗掘事件。
