  重点整治群租房问题


  会上提出,将以整治群租房为重点,按“属地负责、部门尽责,规范管理、消除隐患”的原则,集中开展房屋违法出租问题专项治理工作。


  北京市委政法委副书记、首都综治办主任闫满成表示,通过专项治理工作,最重要的是要先全面摸清出租房屋基本情况,建立健全出租房屋基础台账,落实租赁当事人主体责任,严厉打击房屋租赁过程中的违法违规行为,全面恢复群租房原有规划格局。


  据公安机关介绍,截至上半年,全市有群租房3.8万户,11.9万间,消防治安隐患突出。整治后要取缔群租格局,恢复房屋原貌,依法查处黑中介。经过一年治理,基本杜绝群租房,并形成长效管理机制。


  流动人口登记不低于95%


  据介绍,本次集中整治由首都综治办负责日常协调、推进和督导检查,主责部门包括市住建委、市公安局、市工商局、市规划委、市城管执法局等,属地区县和街乡镇参与地区统筹与协调。


  根据时间安排,明年春节前,重点在北京开展流动人口和出租房屋基本信息大调查和安全隐患大排查;今年12月至明年2月底,重点在全市开展房屋违法出租问题治理试点;明年3月至年底,将全面开展房屋违法出租问题治理,年底前实现违法出租问题基本解决。


  其中,流动人口和出租房屋基本信息调查摸底将于12月6日至12月20日展开,属地流管和公安等部门将对所有在京居住、务工、经商、上学等流动人口的底数全面摸清,确保全市流动人口的登记率不低于95%,出租房屋登记核查工作确保不留死角。

  逾期未腾退上限处罚


  据介绍,在流动人口和出租房屋调查摸底中,对于“叫不开门、见不到人”的房主及租户,相关职能部门要打破常规工作时间,反复登门或早晚入户,健全出租房屋档案。


  在集中治理阶段,逐户同存在违法出租行为的房屋租赁人见面、劝导,对于不配合、逾期未清理腾退的要组织有关执法部门,坚决劝离聚居人员,同时采取帮拆隔断,查扣违法建设经营设备,并实施违法违规上限处罚等措施和手段。


  此外,出租房屋所在地区县政府将统筹建设基层社区(村)出租房屋管理服务站工作,按不低于流动人口3‰或每50至100户配备1名管理员。


  对于与承租人订立房屋租赁合同7天内未办理房屋出租登记手续的出租人,将被责令改正,处200元以上500元以下罚款。


  出租房达10间以上或租住人员达15人以上的,出租人应建相应管理制度,未落实安全责任的可处1万以上3万以下罚款,后果严重的处3万以上10万以下罚款。个人出租房屋收入应及时纳税。


  违法群租


  涉案房屋将限制买卖


  对于房屋违法出租问题治理试点,每区县至少确定两个违法出租问题突出的居民小区(村庄)列入市级重点挂账名单,包括一个“群租”的居民楼小区和出租的违建房屋。


  属地和有关执法部门将加大对进行群租的房屋和从事违法出租的“黑中介”、非法经营的“黑旅馆”的排查发现,注意登记备案,并打击查处。而房地产经纪机构及经纪人员不得参与或教唆他人参与违法房屋租赁活动。


  北京将加强对违法“群租”问题的管理。出租房屋人均居住面积低于5平方米,每个房间居住超2人(有法定赡养、抚养、扶养义务关系除外);改变房屋结构分割出租;将厨房、卫生间改为卧室居住的违法者,处罚出租人。并向社会公开该套房屋信息,限制买卖,并将违法群租信息标注在房屋登记簿附记栏。


  ■ 现状


  群租房屡治不绝有“难点”


  从2009年起,北京对群租房的整治就未止步,但4年来,尽管政策频出,但仍屡禁不止。目前,群租房还是很多小区“公开的秘密”。


  记者走访多家群租房房主、中介及租客,各方都有利益是群租房此消彼长的主因。同时,房价高企,找个房租便宜的房屋实属租客的“无奈之举”。


  朝阳区劲松街道相关负责人介绍,由于劲松地区交通便利,居住人口不断增加,租房需求增加,中介等受利益驱动,产生大量群租房。流动人口的不合理聚集,引发包括环境、治安等问题。如2007年劲松派出所110日均接警40件左右,2011年后升至80余件,最多一天超120件。


  其中,百环家园是整治重点。经两年治理,共治理该小区群租房421户,人防空间791间;首城国际小区群租房125户。上述两小区群租房流动人口从治理前的1.5万余人,减少近4000余人。


  但该负责人认为,群租房整治既是一项难点,也是一项常态工作,要建立常态化治理机制,需政府从街道社区人员编制、经费、执法授权等方面给予支持。


  ■ 探访


  小武基村遍布“三合一”仓库


  位于东南四环的小武基村,除了接连成片的院落仓库,河道污浊,林间垃圾遍布。


  2012年前,这里是著名的大型汽配城,占地12万平米,商户达500余家。


  后因朝阳区回迁房占地,汽配城整体迁往五方天雅汽配城南区,但部分商户滞留下来,遗留的院子和仓库成为物流中转站的发货地。


  记者发现,这些院落和仓库除供货物中转、储藏外,还提供工人住宿。多数仓库都在库房内加盖房屋,供员工及家庭成员居住或办公,有的仓库内还有高低床。


  来自四川的工人李师傅称,仓库内堆积货物后,还有剩余空间可搭建房屋,老板为省钱将其改装后摆进床铺供员工住宿,“这里的仓库都这样,没少住人的。”


  “我们库房房租现在每月1平米五六毛钱,大概有2000平米。”一仓库老板于振江说,他在这里租赁仓库已8年,见惯了很多仓库将居住、办公、生活“三合一”。“我们的人有员工宿舍,不住仓库,怕不安全”。


  外来务工者已成小武基村的主流,“这里房租便宜,很多打工的来这里住,有的过年都不回去。”村民称,约20平米的平房每月租金600元。

  整治群租房历程


  2009年


  市公安局等八部门联合下发规定,要求房屋出租人违法改变房屋结构或使用性质,应恢复原状,并要求出租房屋房主、中介机构配合开展整治违法出租房屋、违法群租房清理整治工作。


  2010年


  各区县开始整治群租房。但据媒体报道,至年底效果未达预期。


  2011年2月


  住建部发布新版《商品房屋租赁管理办法》规定,出租住房应以原设计的房间为最小出租单位,人均租住建筑面积不得低于当地政府规定的最低标准。


  2011年5月


  《关于修改〈北京市房屋租赁管理若干规定〉的决定》正式实施。其中规定,出租人违反出租房屋限制条件的,责令改正,情节严重的,可处5000元以上3万元以下罚款。
