  根据《征求意见稿》规定,在本市具有购房资格的家庭,可在项目公示期内,向房地产开发企业提出购房申请,并按照北京限购政策相关要求,现场提交购房家庭成员身份证、婚姻证明、户籍证明的原件和复印件。


  非本市户籍居民家庭,提交家庭成员身份证明、婚姻证明的原件和复印件,购房申请人签字的《家庭购房申请表》、《购房承诺书》,有效暂住证等材料。其中,经适房、限价房轮候家庭申请购买自住型商品住房的,应提交《北京市城市居民购买经济适用住房/限价商品住房申请备案通知单》和申请人的身份证明材料。

  意见规定,房地产开发企业对购房家庭的申请材料进行初审,符合条件的,在本市自住型商品房资格审核系统中填报家庭信息,并将联机打印的《家庭购房申请表》和 《承诺书》经由购房家庭签字确认后,在审核系统中提交资格审核申请。《家庭购房申请表》一式两份,购房家庭和开发企业各留存一份。开发企业应留存相关申请 材料复印件和经家庭签字确认的《家庭购房申请表》、《承诺书》原件。前述材料将作为购房合同附件,在办理房屋登记时提交登记部门。


  市住建委会同相关部门在20个工作日内,对购房家庭的资格进行审核。购房家庭可登录市住建委官网查询资格审核结果。通过审核的申请家庭,方可参加摇号。对审核结果有异议的,可自资格审核完成之日起10个工作日内,持相关证明材料到市住房城乡建设委申请复核。

  以恒大豆各庄项目为例,本次摇号房源2000个,如通过审核的优先家庭为1500个,要优先这些家庭选房。如有家庭因户型等原因放弃选房,则这部分房源由非优先家庭按照摇号顺序依次选房。

  根据《征求意见稿》规定,自住型商品房摇号结果在北京市住建委网站和项目销售现场公示3天,并在选房之日5个工作日前,在销售现场和市住建委官方网站发布选房公告,明确选房时间、地点、批次安排等。


  摇号、选房过程将由公证机关全程公证,接受属地区、县住房城乡建设主管部门监督,并可邀请社会公众现场监督。摇号结果及选房公告等均要求开发企业在住房城乡建设委官方网站和销售现场公示公告,确保程序的公正性和透明性。

  如果一个家庭购得了自住型商品房,以其中一名家庭成员名字签约,其他家庭成员是否还可能申请购买自住型商品房?

  《征求意见稿》规定,开发企业与购房家庭签订购房合同后,购房家庭的成员今后不得再申请购买自住型商品房;属经济适用住房、限价商品房轮候家庭的,与开发企业签订自住型商品房购房合同后,自动放弃轮候资格。


  据介绍,虽然购买自住型商品房时签约人可以只是一个人,也就是说房产证上只有一个人名字,但在签约系统中,会有家庭成员信息。这样可避免同一家庭重复购买自住型商品房。

  自住型商品房虽属商品房,但与保障房一样,也严格规定了申请流程,如造假取得购房资格有无惩罚?


  答


  《征求意见稿》规定,对通过隐瞒家庭信息,伪造证明材料等方式,弄虚作假,骗购自住型商品房的家庭,一经查实,房企应与其解除购房合同,购房家庭承担相应经济和法律责任,且5年内不得在本市购买住房。构成犯罪的,依法追究刑事责任。


  另外,自住型商品住房取得房屋所有权证后,原则上5年内不得转让。购房人取得房屋所有权证5年以后转让的,如有增值,应当按照届时同地段商品住房价格和该自住型商品住房购买时价格差价的30%交纳土地收益。
