  中共中央首个党内法规制定工作五年规划纲要——《中央党内法规制定工作五年规划纲要(2013-2017年)》昨天正式发布。《纲要》对今后5年中央党内法规制定工作进行统筹安排,确定了一批党内法规重点制定项目。这次编制党内法规制定工作五年规划,在我们党历史上是第一次。


  《纲要》提出,在对现有党内法规进行全面清理的基础上,抓紧制定和修订一批重要党内法规,力争经过5年努力,基本形成涵盖党的建设和党的工作主要领域、适应管党治党需要的党内法规制度体系框架,实现基础主干党内法规更加健全,实践亟需的党内法规及时出台,配套党内法规更加完备,各项党内法规之间协调统一,为到建党100周年时全面建成内容科学、程序严密、配套完备、运行有效的党内法规制度体系打下坚实基础。《纲要》强调,做好党内法规制定工作,要坚持宪法为上、党章为本。


  此次发布的纲要,是在对现有党内法规进行全面清理的基础上,抓紧制定和修订一批重要党内法规,以使权力运行受到更加有效的制约和监督,使党执政的制度基础更加巩固。


  为确保《纲要》各项要求落到实处,中央办公厅将负责分解任务,拟订年度计划,并将强化督察指导,每年将以适当方式通报规划纲要落实进展情况。


  关注一:《中国共产党党组工作条例》



  支持人大、司法机关等按各自章程独立负责


  《纲要》提出,要抓紧制定《中国共产党党组工作条例》(下称《党组工作条例》),明确党组的设立、职权职责和工作方式,规范党组决策程序,进一步理顺党组与所在机构组织的关系,既支持人大、政府、政协、司法机关、人民团体依照法律和各自章程独立负责、协调一致地开展工作,支持国有企业和事业单位依法运营,又发挥党组在这些机构组织中的领导核心作用。


  解读:


  北京大学宪法与行政法研究中心主任姜明安告诉北京青年报记者,《党组工作条例》属于组织性的法规。过去,由于我们不重视法治,组织法制建设一直比较薄弱,不要说党内法规,就是国家法,组织法也很不完善。


  中央党校党建教研部教授张希贤介绍,以往的党组织工作规则不是很清晰,现在党强调依法执政,制定《党组工作条例》是非常必要的,目的在于理顺党组与所在机关、机构、组织的关系。未来制定《党组工作条例》时,一定要考虑到党的领导和各机关独立负责开展工作之间如何协调统一。


  关注二:纪律检查机关案件办理工作条例


  健全网络举报及时查出腐败案件


  《纲要》指出,要整合已有相关制度规定,研究制定《中国共产党纪律检查机关案件办理工作条例》(下称《案件办理条例》),进一步完善办案程序、规范办案措施、提高办案质量。健全网络举报和受理机制、网络信息收集和处置机制,及时揭露、发现、查处腐败案件。


  解读:


  姜明安介绍,近年来,中央和中纪委已就纪检机关办案工作制定了多项党内法规和其他规范性文件。现在的问题是,这些规定过于分散、“碎片化”,有些规定与现时的法治要求、信息公开要求不符,有些规定跟不上反腐形势的发展。因此,要研究制定新的《案件办理条例》。


  姜明安举例说,对新的反腐机制,如网络举报、网络反腐,当前法规并没有予以有效的规范。网络反腐方面,未来可能规范的方面包括,规定向举报人反馈信息、规定受理的时限、规定不予受理应说明理由等。


  姜明安指出,中央最近调整了反腐败有关部门的职能定位,如中纪委对执纪中发现的构成犯罪的案件一律移交司法机关查处,并且不再负责案件的具体指挥协调工作。这一重要转变必然也要在《案件办理条例》中体现出来。


  关注三:党政领导干部问责暂行规定



  严格被问责干部复出条件、程序和职务安排


  《纲要》提出,要完善党政领导干部问责制度。适时修订《关于实行党政领导干部问责的暂行规定》,进一步明确问责情形、规范问责方式。抓紧制定严格做好被问责干部工作安排的有关规定,严格被问责干部复出条件、程序和职务安排等,保证问责制度与党纪政纪处分、法律责任追究制度有效衔接。完善组织处理制度,通过调离岗位、免职、降职等方式,加大对不胜任、不称职干部的调整力度。


  解读:


  近年来,瓮安事件、三鹿奶粉事件、襄汾溃坝事件中被问责的官员相继复出,引来舆论质疑。对此,中央党校教授张希贤分析,严格被问责人复出的前提是,必须在追责的环节理清官员责任,防止责任转移,更要杜绝“找人顶事儿”的现象。


  姜明安介绍,问责包括政治性问责和法律性问责。前者主要针对领导责任(不一定有失职、渎职行为),后者针对违法、违纪、失职、渎职责任;前者的问责形式主要是罢免、引咎辞职、免职、调离岗位、降职等,后者的问责形式主要是党纪政纪处分和追究刑事责任。


  姜明安指出,《纲要》中所谓“做好被问责干部工作安排”是指对政治性问责的规范。现在的问题是,问责主体往往把两种不同性质的责任和责任形式混淆起来。对于政治性问责和“复出”,现行党内法规本已有一些规定,但很不完善,执行起来还打了不少折扣,以至于使很多问责和“复出”受到诸多质疑、诟病。因此,有必要抓紧制定完善问责方面的党内法规。


  关注四:加强干部宏观管理的规定



  严禁超职配备干部、擅自提高干部职级待遇


  《纲要》称,要抓紧制定加强干部宏观管理方面的规定,加强干部政策的规范,清理地方已出台的与中央政策不一致的规定,严禁超职数配备干部,规范干部职务名称,严禁擅自提高机构规格和干部职级待遇,防止干部任职年龄层层递减。


  《纲要》还提出,要完善领导干部待遇方面的党内法规。按照既保证工作生活需要又从严从简的要求,修改完善领导干部住房、办公用房、用车、工作人员配备、医疗、休假休息、交通、安全警卫等方面的党内法规制度,严格规范领导干部工作和生活待遇。


  解读:


  张希贤介绍,目前部分地方存在超职数配备干部的现象。特别是地方机构调整时,有的机构合并后副职数量过多,且短时间内无法消化副职人数。此外,还有的机构擅自提高职级待遇,比如有的处级干部擅自被界定享受副厅级干部待遇等。


  对于规范领导干部住房方面,十八届三中全会提出,要“探索实行官邸制”。国家行政学院教授汪玉凯接受媒体采访时说,近年来干部交流、异地任职力度加大,这为少数干部以权谋房、侵占国家财产提供了机会。比如,一个领导干部到某地任职,地方大都为其准备好了“住所”,这个“住所”往往就成了其个人的资产。


  汪玉凯还建议,要建立领导干部住房申报制度及住房档案,加强动态管理,同时要建立和健全领导干部住房腐败的问责制度,明确住房腐败的问责对象、程序、内容、方法和责任追究范围。


  关注五:党委政法委工作条例



  适时研究制定党委政法委工作条例


  《纲要》称,要加强和改善党对政法工作的领导,积极推进司法体制改革,适时研究制定党委政法委工作条例,完善党领导政法工作的体制机制。


  解读:


  中共中央政治局委员、中央政法委书记孟建柱近日在《人民日报》上撰文谈深化司法体制改革。他说,我国是单一制国家,司法职权是中央事权。考虑到我国将长期处于社会主义初级阶段的基本国情,将司法机关的人财物完全由中央统一管理,尚有一定困难。应该本着循序渐进的原则,逐步改革司法管理体制,先将省以下地方人民法院、人民检察院人财物由省一级统一管理。地方各级人民法院、人民检察院和专门人民法院、人民检察院的经费由省级财政统筹,中央财政保障部分经费。


  张希贤介绍,司法体制改革中地方法院、检察院的管理框架改变,因此政法委的工作机制也要随之变化。
