两个多月前，林森浩刚刚在看守所里度过自己的27岁生日。本来，他应该在离家乡汕头很近的中山大学第一附属医院里工作，他的研究生室友黄洋应该继续在复旦大学上海医学院攻读博士。而现在，黄洋的遗体已经在殡仪馆躺了半年多，林森浩基本上没有可能再回到家乡了。
“我比较注重公平，黄洋就做不到”
7个多小时的庭审中，有近5个小时用于公诉人举证以及被告人和辩护人质证，林森浩发言不多，大多数由其辩护律师代为发表意见。控辩双方对公诉人出具的大量证据的真实性和有效性并无太多争议，公诉人提供的证据大致描述出林森浩从起意到实施投毒直至黄洋死亡的全过程。
上海市人民检察院第二分院起诉书指控，林森浩与黄洋均为复旦大学学生，居住在同一寝室内。林森浩因琐事与黄洋不和，逐渐对黄怀恨在心。2013年3月底，林森浩决意采取投毒的方法杀害黄洋。3月31日下午，林森浩从其实习过的复旦大学附属中山医院影像医学实验室取得装有剧毒化学品二甲基亚硝胺的试剂瓶和注射器，当日17时50分许，林森浩将剧毒化学品全部注入宿舍内的饮水机中。4月1日上午，黄洋从饮水机中接取并喝下已被注入了剧毒化学品的饮用水。之后，黄洋发生呕吐，去医院治疗。4月16日，黄洋经抢救无效死亡。经鉴定，黄洋符合生前因二甲基亚硝胺中毒致肝脏、肾脏等多器官损伤、功能衰竭而死亡。4月12日，林森浩经公安机关传唤到案后，供述了上述犯罪事实。
对于公诉人的指控，林森浩表示，“对投毒的事实没有异议”，但是认为指控中“因琐事不合、决意杀害黄洋”不是事实。
林森浩在法庭上坦言，并非因为读博、生活琐事等原因投毒。从2011年8月起成为室友后，两人关系一般，“不是特别铁，他认为我没有生活情调”。在林森浩眼中，黄洋是个很聪明的人，但有些自以为是，和自己的性格、价值观有较大差异。但两人并没有直接的矛盾和冲突，只是对他有点看不惯，“有时候我们也会聊聊理想”。
林森浩说，黄洋喜欢和同学开玩笑，偶尔也和他开开玩笑，“但我并不是都能接受”。当公诉人询问其哪些玩笑不能接受时，林森浩表示自己记不得了，但又补充了一句，“我比较注重公平，对人对己的标准要一样，黄洋就做不到”。
多个同学的证言显示，黄洋曾经假借林森浩的名义批评同宿舍另外一个室友葛某不讲卫生、乱扔东西，林森浩知道后非常生气。
公诉人还出示了一组证人证言。证言中透露，黄洋为人较为强势、说话不注意他人感受。他曾以开玩笑的方式评价林森浩生活细节，嫌弃林森浩小气。这些事情被林森浩知道后，林森浩很不高兴。不过林森浩对这些证言称，每个人的看法都不同，他对黄某并没什么不满。
葛某也是林森浩在中山大学时的本科同学，因为家在上海，所以并不是一直住在宿舍，经常会回家居住。在他眼里，黄洋比较外向，也敢于直言评价同学，而林森浩则有点记仇，但很顾家，学习也不错。三人关系比较微妙，但在外人看来，“最起码表面上还是很和谐的”。
林森浩的导师认为林很自我，和同学说话不注意方法，太直接。同学也证实，林森浩性格内向，平时和寝室同学交流不多。
“你要整别人，那我就整你一下”
“这可能只是一个巧合”，在回答公诉人为何投毒的问题时，林森浩的回答让不少人吃了一惊。
林森浩回忆，3月30日晚上，他在对面的413宿舍和同学聊天，黄洋也过来聊天，提到愚人节（4月1日）就要到了，要整一下同学，还举了例子，把正在睡觉的人的脚放在温水里就会让他尿床。“我当时就想，你要整别人，那我就整你一下”。
至于为何要投入二甲基亚硝胺，林森浩的解释是以前听说过别人用毒物害人的事情，还曾经看到过一篇关于清华大学投毒案（即朱令铊中毒案——记者注）的报道，“后来也没有查获，我也没有想后果，就做了。”
第二天（3月31日），林森浩开始了行动。下午，林森浩两次来到中山医院11号楼204实验室，借故要看看以前使用的实验用品，向师兄吕某借了钥匙，第一次吕某在场，林森浩确认了一下自己在2011年做实验剩余的二甲基亚硝胺还放在原来的位置，但并没有拿，“一是因为没有准备装的东西，二是怕被吕某看到”；第二次吕某在另外一间实验室，林森浩自己拿着204室的钥匙并向吕某借了一个黄色的医疗废弃物袋子，从204室的柜子里取出了装有二甲基亚硝胺的瓶子及注射器，并放入黄色袋子里，随后带回了宿舍。值得一提的是，在回宿舍前，林森浩还约了同学盛某一起在食堂吃了晚饭，还是林刷的饭卡。
回到宿舍后，林森浩看到饮水机的水桶已经没有多少水了，先是把水桶拿下来，但发现不方便投入毒物，于是就把水桶再放上饮水机，然后用左手把水桶倾斜，露出水芯，右手用注射器把二甲基亚硝胺注入饮水机。由于不小心边上溅了几滴，林森浩还用一瓶矿泉水冲了进去。至于一共倒了多少二甲基亚硝胺，林森浩一开始供述约20～30毫升，后经公安部门侦查实验，应为约50毫升。
随后，林森浩把装有注射器的透明塑料袋扔在了宿舍楼的垃圾箱里，把装有二甲基亚硝胺瓶子的黄色袋子扔到了距离宿舍楼两分多钟路程的第二教学楼旁的一个垃圾箱里，“因为觉得黄色袋子太显眼”。他没有想到的是，这一过程都被宿舍楼及校园里的摄像头记录了下来。
回到宿舍后，林森浩开始在网上搜索二甲基亚硝胺的相关信息，包括以“二甲基亚硝胺 味道”“二甲基亚硝胺 中毒”等为关键词，但他表示自己只是大致浏览，对二甲基亚硝胺的毒性、“可致人死亡”等不是特别敏感，只是觉得“可能黄洋会难受，但是没有想到这么严重的后果”。林森浩把这一点归结为自己“性格不够果断”，“我觉得二甲基亚硝胺是黄色液体，也有浓烈味道，就让它去吧。”林森浩没有放弃。
当天21时40分左右，黄洋回到宿舍后，两人并没有交流，各自睡去，这种情况两人也已习惯。
十多天中未采取任何补救措施
4月1日8时许，惨剧拉开了帷幕。林森浩供述，他在床上听到黄洋起床的声音，并且拿着自己的杯子去饮水机处接水，这是黄洋的习惯——每天早上起床空腹喝一杯水。
这时的林森浩还在装睡，他听到黄洋喝了一口水马上呕吐了出来，但他依然躺在床上没动，“因为怕他问我”。随后，林森浩听到黄洋拿着水桶到洗手间去冲洗，正在这时，林的手机响了，一个同学约他到浦东办点事情，林马上借机离开了宿舍。
18时许，林森浩回到宿舍，发现黄洋躺在床上睡觉，于是就拿着电脑回到自己的科室，这时他开始有些慌张，又开始在网络上查询二甲基亚硝胺的相关信息，确认了该药物对肝的损伤，但他依然没有采取任何补救措施。23时50分，林森浩才回到宿舍，看到黄洋仍然躺在床上睡觉，只是呻吟了两声，林森浩也没有同黄进行交流，独自睡去。
黄洋喝了饮水机里的水出现不适后，曾在其他同学陪同下赴中山医院超声科检查。林森浩表示，作为实习医师的他在为黄洋做B超时说，“你胃没有问题，肝也没有问题”，不过说完他就知道说多了。
林森浩说，在黄洋被送进重症监护室后，自己还有侥幸心理，认为黄洋不会死。“4月5日，我跟同学去看过他。当时他在我们重症监护病房，从玻璃窗看到他的表情很自然。我当时不敢跟他说话，同去的同学都跟他说话了。在路上，我说这是个病程，以后会好转，这也是我的一个自我安慰。6日，我一个人去了医院，碰到了他的父亲和一个会诊的医生。8日我又去了，想去看他好转没有。”
此前，林森浩曾在大鼠上做过相关实验，注射二甲基亚硝胺稀释液，并撰写、发表了多篇学术论文。当被问到为何没有告知黄洋病因时，林森浩表示：“我认为黄洋这是一个病程。第一，当时我认为黄洋喝下去的剂量是很少的；第二，我实验中的大多数大鼠并没有死亡。”他说，自己做实验的那些大鼠大部分在20多天后自行修复，“生龙活虎”。
之前有新闻报道中所提到，黄洋的师兄孙某收到对事件起关键性作用的神秘短信，其实是室友葛某发的。葛某的证词显示，葛某感觉黄洋像中毒，就去看了病理资料，联想到林之前做过类似的实验，上网搜论文后，发现林写过二甲基亚硝胺导致肝功能受损论文。发现之后打电话给孙师兄，让他调查，孙问为什么，这时候正好林回寝室，他就只能发短信给孙。
黄洋发现水有异味后把饮水桶拿下放在桌子底下，葛某称如果不是黄洋提醒他水有怪味，他也会喝饮水机里的水。
愿接受一切法律惩罚
二甲基亚硝胺究竟从何而来？公诉机关提供的证人证言中显示，复旦大学上海医学院影像医学与校医学专业博士研究生吕某某说，她于2011年从天津市化学试剂研究所购买了二甲基亚硝胺原液。当年实验结束后，所剩试剂放置于复旦大学相关实验室内，她与林森浩都知道该原液摆放的位置。
公诉人出具证据显示，从3月6日起至投毒后，林森浩曾多次上网，以“二甲基亚硝酸胺”、“二甲基亚硝酸胺味道”、“二甲基亚硝酸胺中毒”、“毒物分析”、“司法鉴定中心”等为关键词，阅览了百度知道、百度百科等相关页面。
公诉人在法庭辩论阶段称，林森浩作为一名成绩优秀的在读医学研究生，他清楚地知道，二甲基亚硝胺超量注入将致人死亡。林森浩写的多篇论文和硕士毕业论文中，对二甲基亚硝胺的毒性有着详细的描述，充分证明林森浩主观希望杀死黄洋。
公诉人认为，林森浩对犯罪后能逃脱法律惩处抱有侥幸心理。首先，校内没有第3个人知道二甲基亚硝胺还存放在实验室，二甲基亚硝胺致死的案例此前也很少见。此外，林和黄的矛盾在周围的人看来，都是些鸡毛蒜皮的小事，一旦黄中毒，很难让人联想到林身上。这些有利条件和因素坚定了林实施投毒的信心。
公诉人在庭审上表示，故意杀人的犯罪事实是成立的，证据确实充分，被告人林森浩应该承担相应责任。
林森浩并没有进行自我辩护。辩护人在陈述中表示，黄洋的死亡不是林森浩的主观追求；林森浩在接受问询时如实供述了犯罪事实和犯罪动机，依法应当从轻处罚。
双方争议的焦点是林森浩究竟是直接故意杀人还是间接故意杀人，林森浩的作案动机究竟是因为琐事产生不和怀恨在心，还是仅仅想捉弄一下被害人，对林森浩的量刑究竟是应依法严惩还是从轻处罚？
辩护人举例说，林森浩事后在网上查询二甲基亚硝胺相关信息，公诉方认为是林在研究如何让黄致死，而他的理解是林是由于害怕，最好希望黄别死。公诉方提出，由于黄洋被录取为博士研究生基本不成问题，而林森浩没有报考博士而产生嫉妒心理，辩护人则表示，林森浩已经找到一份理想的工作，不存在嫉妒黄洋的心理。
林森浩在回答诉讼代理人疑问时表示，自身性格内向，对为人处世的方法缺少正确的认识；讲话、做事不计后果，遇问题有逃避的习惯，这两点是导致他犯下罪行的根源。
他在最后陈述时称，在看守所里这几个月，一直在寻找自己的犯罪根源，自己的行为造成了黄洋的死亡以及对其家人的伤害，他感到罪孽深重并当庭表示对不起，同时他也表示对不起父母近30年的养育之恩，愿接受一切法律惩罚。
