案件直到今天仍在搁置中。李三仁和尚爱云夫妇，每周都要去内蒙古高院询问进展，可是多年来没有任何结果。
他们现在每周到呼格吉勒图的墓前，抱着墓碑大哭一场。在深秋寒冷的早晨，这对夫妻再次来到儿子的坟前，为儿子烧了寒衣。

案情回溯
17年前女厕内发生命案
时间回到1996年4月9日晚上，呼和浩特市新城区诺和木勒大街内蒙古第一毛纺织厂宿舍57栋平房西侧的公共厕所内，出现一具女尸。呼格吉勒图是报警人。
当年刚满18岁的呼格吉勒图，是呼和浩特卷烟厂工人。他和闫峰年龄相仿，又是同天进厂上班，经常在一起玩，两个人是好朋友。
对当年的一幕幕，闫峰记忆犹新。他回忆，1996年4月9日，他和呼格吉勒图都是下午班。晚上8点左右，两人到烟厂南面的一个小饭馆吃晚饭。
他们点了主食和一个凉菜，每人“喝了3两白酒”。饭后，他们一起回厂上班。快走到厂子门口时，闫峰让呼格吉勒图买两块泡泡糖。按照厂里规定，上班时间不能喝酒，只能用口香糖去去酒味。
闫峰说，过了十几分钟，呼格吉勒图回到车间，给了闫峰一块泡泡糖，然后就回了自己的工位。
闫峰说，两分钟后，呼格吉勒图过来找闫峰，说出事了，让他和自己再出去一趟。具体出了什么事，呼格吉勒图不说。
走到烟厂十字路口东北角毛纺厂宿舍的公厕时，呼格吉勒图才说，刚才自己回家取钥匙的路上，听到女厕所里有人在喊，里面肯定出事了，他要闫峰跟他一起进去看看。
闫峰觉得进女厕所不合适，拒绝了。但呼格吉勒图坚持要进去，两个人在路边迟疑的时候，有两个老太太进了厕所，几分钟后两个老太太出来朝南走了，没有任何异常。
闫峰觉得厕所里肯定没有出事，可呼格吉勒图仍然坚持说里面出事了，一定要进去。
闫峰最终同意了。他在前，呼格吉勒图在后，站在女厕所门口，“先喊了两声，里面没动静”，“打着了打火机照了一下，一个女的裸露着下身仰躺在厕所的矮墙上”。
18岁工人报警后被拘留
闫峰说，看到这一幕后，两个人转身就跑。跑出小巷后，呼格吉勒图说要报案，闫峰劝他不要多事。但因为呼格吉勒图的坚持，两个人还是到巷口不远处的治安岗亭报了案。
呼格吉勒图拉着警察去看现场，让闫峰回烟厂帮他请假。闫峰回到车间后，向车间主任说了报案的事。
当晚10点多，警察到车间把闫峰带走。呼格吉勒图也被带走，和闫峰一起被送到新城区公安分局，分别单独讯问。
房间相隔不远。闫峰记得，自己被问到次日凌晨2点多。其间，他听到呼格吉勒图喊叫和桌椅挪动的声音。
天亮后闫峰获准回家，后来警察又找他录过几次笔录。
但呼格吉勒图再没能回家。有一次闫峰去分局，他从门缝里看到呼格吉勒图被铐在暖气上。
报警人被当做凶手俩月后枪决
1996年5月23日，呼格吉勒图案开庭审理。
检方以“流氓罪”和“故意杀人罪”两项罪名对呼格吉勒图提起公诉，提交的证据包括“证人证言、公安机关刑事科学技术鉴定书、物证检验报告、尸体检验报告以及现场勘查笔录”。
检方指控：1996年4月9日20点40分许，呼格吉勒图酒后到第一毛纺厂宿舍院公厕外窥视后，进入女厕所。
他对25岁的杨某采取捂嘴、扼颈等手段，将她按在便坑的隔墙上，掀开衣裤，进行流氓猥亵行为，听到外面有动静，呼格吉勒图逃离现场，而杨某因被扼颈窒息当场死亡。
当地政法机关的知情人透露，检方做出指控的逻辑是，呼格吉勒图和闫峰聊天时，曾经流露过某些对于性的想法。当晚，呼格吉勒图和闫峰分开后，他到距离卷烟厂5分钟左右路程的女厕所实施犯罪，然后回到车间，故意拉着闫峰到女厕所去发现尸体，然后又假意报警。
李三仁和尚爱云记得，庭审时间不长，检方宣读公诉意见，律师开庭伊始为呼格吉勒图做的都是无罪辩护，但后来以“认罪态度好”等理由做出求情陈述。
短暂的休庭合议之后，法官当庭宣判，以“故意杀人罪”判处呼格吉勒图死刑。
6月5日内蒙古高院二审裁定“维持原判”。6月10日，在案发仅仅两个月之后，呼格吉勒图被执行死刑。
父母回忆
儿子当庭喊冤被扼住喉咙拖回
尚爱云记得，庭审时，他们夫妻在案发后第一次见到儿子。
当时呼格吉勒图试图跑向他们，但很快就被法警扼住喉咙拖了回去。“儿子对我们喊，我是冤枉的，我没杀人。”她说。
6月10日早晨，囚车驶离看守所时，他们再次隔着囚车的铁窗见到儿子。
当年，警方侦破此案的消息还被当地媒体广泛报道。
报纸上登载的《4·9女尸案侦破记》描述，警方在“熬了48个小时之后”，终于获得了呼格吉勒图的供词。
为了证实供词的真实性，“由分局刑警队技术室对他的指缝污垢采样，进行理化检验。市公安局技术室和内蒙古公安厅进行了严格的科学鉴定。最后证明呼格吉勒图指缝皮屑与被害者咽喉被掐破处的血样是完全吻合的”。

他人被抓后自认公厕奸杀案
2005年10月，一个叫做赵志红的人因连续犯下命案落网。
他的落网，让呼格吉勒图案再起波澜。赵志红交代，1996年4月9日，他在毛纺厂公厕内奸杀了一名女子，其所交代的内容与警方当年掌握的证据完全一致。虽然案发现场早已不存在了，可是赵志红仍然很准确地带警方找到了现场。
当时很多人看到这个情景，他们马上通知了李三仁和尚爱云。这时，夫妇二人意识到，自己的儿子一定是被错杀了。
据呼市公安局当年一位办案负责人称，赵志红落网后，警方连夜对他进行第一次审讯。当时，赵志红交代了4起命案，第二天进行第二次审讯时，赵志红交代了“409案件”(即呼格吉勒图案)。
这位负责人表示，赵志红交代此案后，警方立刻进行复核，基本确定409案系赵志红所为。
之所以如此肯定，有个佐证：赵志红在交代这起案件时，还交代了一起无人报案、公安机关也不掌握的案件。
在一处河滩上，赵志红带着警察找到了埋尸地点，死者是一名女子，也是被奸杀。
赵志红留给警方的印象是，人非常聪明，记忆力超群。
经过讯问，赵志红承认共作案27起，其中命案10起，当中包括“409案”。但法院开庭审理此案时，检方的起诉书中未提及“409案”。
原因是，当年的唯一证据，也就是从呼格吉勒图指甲缝里提取到的皮屑，在化验后已经灭失，没有其他证据证明赵志红是凶手。
在法庭上，赵志红说，检方指控未提及“409案”，因此，法庭只得休庭，赵志红则被继续关押。
实地采访
公厕原地盖了楼房
日前，《法制晚报》记者到案发地采访。
如今，李三仁、尚爱云夫妇的住处，距当年的案发现场步行仅需5分钟。只不过，案发的公厕已经拆掉，原地盖起了楼房。
李三仁，这个已经72岁的老人，寡言少语。只有在《法制晚报》记者面前说起儿子时，话才多起来，“我儿子没杀人，他是个好孩子，我自己的儿子我了解。”
再次来到案发现场，李三仁的脸上布满泪水。面对曾经的公厕所在方位，他不愿多看，蹲在地上半天没起身，一只手不断地抠着墙壁上的灰。
在尚爱云眼中，呼格吉勒图是个听话、老实的孩子。“那年，他本来要去当兵，结果没去成，就进了烟厂上班，如果他活着，现在已经结婚生子了。”
对这对老夫妻来讲，呼格吉勒图的死也影响了自己的小儿子。
小儿子当年学习很好，成绩名列前茅，按部就班地读书，完全可以考上大学。
因为呼格吉勒图的案子，小儿子在学校里备受老师和同学的冷眼，头发大把大把地掉，最终无心学习，再也不想去读书了。
“我们失去了一个儿子，另一个儿子也被彻底毁了。”她说。

直到现在，赵志红仍然身在看守所内。
为了防止赵志红出现意外，当年承办呼格吉勒图案的所有警察都被禁止加入“409案”复核小组，有关部门还从武警调来6名战士专门看押赵志红。
据当年承办赵志红案件的负责人讲，他复核呼格吉勒图案时，调取了当年的卷宗，还找了一些知情人了解情况。
当时指向呼格吉勒图杀人的证据只有指甲缝里的皮屑，仅以此作为呼格吉勒图杀人的证据。
“他的指甲缝里的皮屑组织与死者血型相符，以此就能断定他是凶手吗？也许他进入女厕后，用手摸了一下死者，指甲里留下了皮屑，这怎么能证明他就是凶手呢？”
这位负责人还透露，呼格吉勒图被审讯时，第一次根本没有供认，第二次加大了审讯力度，他才招认了，“加大审讯力度，其中大有名堂。”
当年做笔录民警不久前去世
这位负责人告诉《法制晚报》记者，为了复核呼格吉勒图案，办案人员还将复核结果拿到公安部刑侦局。
多位专家断定被错杀。公安部领导指示，此案要慎重，必须有确凿证据。
“当时领导批示说，协调检法，由政法委牵头复核，要高度重视，快查快办，部里要请专家到内蒙古会诊此案，呼市要实事求是，所有能找到的证据要重新认定，包括赵志红的有关证据。”
