原来，刘小姐在2011年9月与交往一年半的男友曲某华分手。而就在裸照发出当天的15时30分，曲某华就曾打电话问她还有无复合的可能，但被她拒绝。曲某华放出了要“做坏事”的狠话，通过自己掌握到的刘小姐的密码，登录了刘小姐的人人网账号发出了裸照。
据曲某华供述，这些裸照是他之前与刘小姐裸聊时截图得到的。发裸照的目的，是想让大家知道刘小姐不是大家眼中的乖女孩，是一个放荡的女生。他还想让刘小姐的新男友看到后放弃刘小姐。
求复合不成勒索两万元
事情还没有结束。次日早上8时43分，刘小姐又接到了同学王某发来短信，问她在开心网上“搞什么”。刘小姐马上登录开心网，发现自己的账号密码已被修改。她用其他账号登录查看，发现被改了密码的账号头像被换成了半裸头像，还新建了两个相册，内有一些她本人的裸照。
她随即致电开心网客服删掉照片。但在有照片被删的同时，也有照片不断更新。两天内，她就有50张裸体照片被传上了该网。
同一天，刘小姐的同一账号还被发布了一条新消息，公布了她的手机号码、工作单位，以及“包夜1000元、熟人八折”等内容。此后，她又陆续接到了曲某华发来的短信，大概意思都是要她归还欠他的东西。
曲某华供称，他发出了众多裸照后，发现刘小姐的新男友不为所动，感觉到他们之间的感情无法挽回了，就提出要刘小姐“归还”他2万元，并威胁她，不给钱就将她的不雅照发到她家人的手机上。
辩解：发裸照与要钱无关
同月21日，刘小姐给曲某华汇去了2万元，随后选择了报警。2012年8月30日，警方在山东烟台将曲某华抓获，南海区检察院以敲诈勒索罪追究其刑事责任。
法庭上，曲某华否认控罪，声称他与刘小姐谈恋爱时，每个月都给她钱，前后共给了约3万元；且两人交往期间所有的消费全是他一人付款，所以才会在两人分手后追讨2万元。至于发裸照，曲某华则说是因为一直收不到钱，一时生气才这么做，与索要2万元之间没有必然联系。
刘小姐则反驳说，他们一起生活期间的开支都是轮流支付，基本平摊，“不存在谁欠谁的钱。”
一审判定构成敲诈勒索
南海法院经审理后指出，由于曲某华未能证明他向被害人索要的2万元是被害人欠他的合法债务，被害人对此亦不予确认，因此法院对曲某华提出的涉案2万元属于合法债务的意见不予采信。
南海法院认为，被告人曲某华以非法占有为目的，采用威胁方式，强行索取他人财物，数额较大，其行为已构成敲诈勒索罪。据此，法院一审判处其有期徒刑一年六个月，并处罚金人民币5000元。
