案犯面无表情女友旁听落泪
昨天上午，双方都有亲属参与旁听终审宣判，但均未接受记者采访。韩磊的父母和发小没有出现，而其一直未曾露面的女友则前来旁听。
上午9时30分，韩磊和李明被带进高院第六法庭。韩磊不停扭头看向旁听席，看到女友，韩磊笑着点了点头。
在法官宣读判决书时，韩磊一直抬头看着审判长，脸上无任何表情。当审判长念出“本案维持一审判决”时，一直在旁听席上的韩磊女友突然落泪了。宣判结束后，韩磊被带出法庭，其间他再次望向女友，脸上仍挂着一些微笑。
事后，韩磊的辩护人徐平律师表示，韩磊父母有心理准备，虽然他们已经准备出钱赔偿受害人家属，但直至宣判前女童父母都未接受。“宣判前韩磊父母好像见到了被害女童的家人，但对方不肯接受赔偿，如果能接受，或许对案件有帮助。”

上诉理由被驳维持一审判决
法院认为，韩磊曾因犯罪被处以刑罚，但仍不思悔改，在刑满释放仅九个月后，又故意非法剥夺他人生命，致幼童死亡，其行为已构成故意杀人罪，罪行极其严重，依法应予惩处。同时，韩磊所提上诉理由，缺乏事实及法律依据，不能成立，应予驳回。韩磊的辩护人所提建议改判或发回重审的辩护意见，依据不足，法院不予采纳。检察院建议驳回韩磊的上诉，维持原判的意见理由充分，应予采纳。
最终，市高院裁定维持一审判决，韩磊犯故意杀人罪，判处死刑。

韩磊出事之后，其父母四处打听被害人的家庭地址，并7次登门道歉，其中两次碰到家中有人，但对方均表示“不愿见面”，并将他们拒之门外。
在韩磊年幼时，我因为工作原因去四川支援建设，从小未尽到教育儿子的责任，但我相信儿子在法庭上说的是实话，没有撒谎。他到底是不是故意的，只有他一个人清楚，但是我相信我的孩子。
韩磊提出的测谎等要求都没有得到允许，如果真的查明他是故意的，不单是法院，我们老两口都不能饶他，但是他连个查真相的机会都没有。我认为查真相有两个目的，一是告慰死去的婴儿，二是让社会知道，韩磊并非大奸大恶。
我经常想，假如能用我的生命去换死去婴儿的生命，我会义无反顾地去交换。我们非常想和受害人的家人达成和解，不仅是为了儿子，也想真诚地给受害人赔罪，让自己的良心得到些许宽恕。

◎7月23日晚韩磊乘坐李明驾驶的北京现代牌轿车至大兴区旧宫镇庑殿路附近，因停车问题与李某发生争执。随后，韩磊对李某进行殴打，后将李某两岁10个月大的女儿从婴儿车内抓起举过头顶，重重摔在地上，致女童因重度颅脑损伤死亡。之后，李明驾车带韩磊逃离现场。
◎7月24日韩磊被民警抓获。
◎7月25日李明主动投案自首。
◎7月26日被摔女童经抢救无效死亡。
◎8月20日市检一分院以故意杀人罪对韩磊依法提起公诉，以涉嫌窝藏罪对驾车帮助韩磊逃离作案现场的李明依法提起公诉。
◎9月16日此案在市一中院一审开庭。庭审时，韩磊一再辩称，他是近视眼又喝了酒，以为李某推的是购物车，并不知道摔了孩子。
◎9月25日市一中院以故意杀人罪一审判处韩磊死刑。同时裁定准许受害人家属撤回此前对韩磊提出的总计273万余元的附带民事诉讼请求。同案李明犯窝藏罪被判处两年，与其前罪尚未执行完毕的刑罚并罚，决定执行有期徒刑五年。韩磊提出上诉。
◎11月19日市高院二审开庭审理此案。韩磊的辩护人将监控录像绘制成图像向法庭出示，并按时间节点以文字形式进行分解说明，证明韩磊没有看清楚，发生误判。韩磊希望可以向被害人家属当面道歉，并针对检方出示的证据向法庭要求对其本人和该案证人进行测谎。
