  多方研讨空难赔偿问题


  昨天上午,空难部分幸存者、遇难者家属、生还机长齐全军的辩护律师张起淮,以及有关航空法律方面的专家,召开了一个“航空法律运输问题”研讨会,主要内容是我国航空法律方面有关空难赔偿的问题。


  张起淮介绍,他在会上主要讲了4个问题:一是废除现行的赔偿限额;二是建立强制保险;三是要完善行业法规;四是现行《民航法》滞后于其他法律,要让其与其他法律相接轨。张起淮表示,此次研讨会也是对幸存者和遇难者家属在申请赔偿方面进行一些指导。


  一些幸存者表示,此前对我国现行的空难赔偿规定并不是很清楚。幸存者陈女士在参加完研讨会后称,将依照现行的法律政策,主张自身的合理赔偿。


  据张起淮介绍,在前天庭审最后的陈述阶段,齐全军做了一个15分钟的陈述,其间他一直在流泪,“他对事故中的逝者和伤者,表示愧疚,也表示愿意卖房卖车进行赔偿”。


  而对于齐全军赔偿的意愿,幸存者陈女士和米女士都表示,从她们个人的角度来说,“应该不会对他提起赔偿诉讼,他也是一个受伤害的人”。


  据悉,在庭审中,检方建议对齐全军4至6年的量刑。辩护律师张起淮认为,从该案客观实际情况、多因一果以及齐全军的认罪态度来看,3年以下的缓刑比较合适,如果超过这个则有点重。

  陈女士旁听了前天的庭审过程。她表示,当班机长齐全军被追究刑责,让她看到国家法律在进步,“但是也存在很多不足”。


  陈女士说,她们最主要是想追究相关责任人的责任,在旁听过程中她曾听到这是“黑飞”,而伊春空难是三新组合:新航线,通航三星期;新机场,投入使用一年;新公司,河南航空公司是一家仅成立3年的支线航空公司。“我觉得齐全军是一个替罪羊,有很多相关责任人都未受到处理,不是很公平。”

  3年前的那场空难,米女士和9岁的儿子幸运逃生,但是空难对他们的身体造成了很大的创伤。“其实我都没什么,但是我儿子真的是……”提起儿子,米女士哭得说不出话来,“恨自己为什么当时要带他去伊春”。


  米女士说,3年多来儿子身体并没有好转。“他对很多东西都过敏,包括染色剂。他现在的内衣全部都只能穿白色,连床单被罩也是”。目前米女士的儿子每天都要打针,她自己也要服药。


  前天的庭审,也是事发后米女士第一次回到伊春。“我丈夫并不同意我来参加,因为每次谈到此事,我们都要花很久才能将情绪平复。”


  空难发生后,陈女士和孩子直到去年冬天才又坐了飞机。“我们先从哈尔滨坐火车到北京,休整一天后再坐火车到广州,最后从广州飞到三亚。”即便是这一小段飞行,也仍然让陈女士非常害怕,“直到飞机落地十多分钟后,才缓过劲走下飞机”。


  这次庭审期间,陈女士见到了齐全军的妻子并进行了简短的交流。“我告诉她,我们肯定不会成为朋友,因为齐是一个重要责任人之一,给我们造成了伤害。但是我们也绝不会成为敌人,因为他也是受害者。”

  灾后“偶遇”生还机长意识清醒不回答问题


  2010年8月24日伊春空难发生后,作为第一时间抵达现场的媒体,新华社记者记录了一些鲜为人知的细节。

  时隔两年后发布的空难调查报告认定,齐全军未履行《民用航空法》关于机长法定职责的有关规定,直接导致事故发生,并且在飞机撞地后,没有组织指挥旅客撤离,没有救助受伤人员,而是擅自撤离飞机。
