Guangzhou corruption SOE bosses moved 19 million sentenced to life， the High Court remanded

　　南都讯 记者任先博 2012年，广州金保贸易原董事长(2009年7月之后更名为广州金保投资管理有限公司，下简称“金保”)王道军因涉嫌将约1900万元公款贪污挪用到自己开设的私营公司，被广州市中院一审以贪污罪和挪用公款罪判处其无期徒刑。近日，该案经省高院审理后作出刑事裁定：王道军犯贪污罪部分事实不清、证据不足。发回广州市中级人民法院重新审理。

　　据一审法院判决书及此前官方媒体综合报道显示，1966年5月8日出生的王道军，不到40岁就成为了金保董事长。在任期间，挪用公款用于设立自己的私人公司。先是利用金保公司侵吞公款。屡屡得手后，又以金保名义与客户谈业务，然后又用自己私企的名义与对方签订合同，将金保的八大业务转移到自己公司名下。

　　2012年10月24日，广州中院作出刑事判决，判处王道军无期徒刑，并处没收财产100万元。随后，王道军不服，以一审法院对其所犯挪用公款罪量刑过重以及一审法院认定其犯贪污罪事实不清、证据不足为由提出上诉。近日，该案经省高院审理后，决定发回广州中院重新审理裁定。
