最高法人士称非法证据排除有利于保障人权
法制晚报讯(记者汪红) 昨天，最高院刑五庭庭长高贵君在“非法证据排除规则实施问题”研讨会上表示，几乎每起冤假错案背后都有刑讯逼供存在，建立非法证据排除制度有利于保障人权。
高贵君说，冤错案件的出现影响了司法机关的公信力及国家的形象，甚至影响到公众的法治信仰。从最高院的调研来看，几乎每起冤假错案背后都有刑讯逼供存在。
早在佘祥林案件出现后，最高院就起草了非法证据排除的有关规定，只是当时对此问题未形成共识，文件没有出台。赵作海案件出来后，引发了全社会对非法证据排除问题的高度关注。2010年，两高联合发布了《办理刑事案件排除非法证据若干问题的规定》。
《刑事诉讼法》修改将非法证据排除制度上升为法律规定，从制度上进一步遏制刑讯逼供和其他非法收集证据的方法，对于尊重和保障人权具有重大而深远的意义。
中国人民大学教授戴玉忠说，建立一个科学、完备、有效的非法证据排除规则并贯彻实施，将有利于保护犯罪嫌疑人、被告人的权利；减少和遏制冤假错案发生。
