此次陕西省首次以立法形式明确规定，凡建成50年以上具备以下五种条件之一的建筑都是重点保护建筑。譬如，建筑类型、空间、样式、施工工艺和工程技术等具有建筑艺术特色或者科学研究价值的，反映本省历史文化和民俗传统并具有时代特征、地域特色的，在产业发展史上具有代表性的作坊、商铺、厂房和仓库等，历史名人故居、旧居，以及其他具有历史、科学、文化、教育、艺术价值的建筑。
近年来中国在城乡建设中建筑保护力度不够，损毁、拆除具有历史风貌和地方特色的建筑时有发生，具有一定价值的建筑在日常维护、维修中存在一些空白地带，严重影响其存续。同时，一般建筑寿命相对较短，既造成了严重的资源浪费也产生大量建筑垃圾，但对随意破坏拆除建筑缺乏相应的法律制约手段。
根据条例，重点保护建筑根据其历史、科学和艺术价值、完好程度划分为四类实施分类保护。一类重点保护建筑不得改变建筑的立面、结构体系、平面布局和内部装饰，二类重点保护建筑不得改变建筑的立面、结构体系、基本平面布局和有特色的内部装饰，三类重点保护建筑不得改变建筑的立面和结构体系，四类重点保护建筑不得改变建筑的主要立面。
陕西省建设厅副厅长张阳表示，保护条例从认定、保护分类、责任主体、划定保护范围、经费补助等方面采取严格的保护措施。规定重点保护建筑的修缮保养由政府资金支持，鼓励民间资本介入，通过发展旅游和相关产业，实行开发与保护并重，具有较强的可操作性。
