  2010年“8·24”伊春空难三周年后,昨天上午,东北小城黑龙江省伊春市伊春区法院,飞行员齐全军因涉嫌重大飞行事故罪出庭受审。这是中国空难事故后追究飞行员刑责的首个案例,也是目前唯一一名进入司法审判程序的事故责任人员。


  机长被指控负直接责任


  国务院事故调查组在历时两年的调查后,最终认定这是“一起责任事故”,由诸多直接原因和间接原因造成,并建议对20名责任人党纪、政纪处理,其中机长齐全军涉嫌刑事责任。


  2012年6月29日,事故调查报告对外公开发布。报告发布前一天,齐全军被刑事拘留,同年7月10日被逮捕,10月10日该案移送检方审查起诉。


  检方指控,齐全军对空难发生负有直接责任,理由有三:在飞临机场时,齐全军违反规定,低于公司最低运行标准实施进近;在飞机进入辐射雾未看见跑道、没有建立着陆所需的目视参考下,机组违反规定仍然穿越最低下降高度实施着陆;在飞机撞地前出现无线电高度语音提示、且未看见机场跑道时,机组未采取复飞措施,继续盲目实施着陆,导致飞机撞地。


  2013年1月,检方将此案起诉至伊春市伊春区法院,法院在经过两次庭前会议后决定开庭审理此案。


  辩方指事故属“多因一果”


  昨天上午的庭审中,齐全军对指控事实持有异议。他称,自己在最低下降高度时看到了跑道灯,错误在于听到无线电高度语音提示时,迟疑了一秒钟后做出的复飞动作不够完整,因此没有来得及将飞机拉起来。他还认为事故发生主要在于河南航空的运行计划不合理、飞机没有安全保障、机场存在问题等因素。


  本案中,北京市蓝鹏律师事务所律师张起淮和胡爱军担任齐全军的辩护人。辩护律师认为,该起事故属于“多因一果”,由多种原因造成,“而‘8·24’事故调查报告将一切问题都归责于被告人齐全军及机组,对相关行政部门、河南航空、伊春机场的问题都是轻描淡写未暴露。”


  案件判决起判例作用


  本案是中国刑法实施以来,飞行员被首次指控涉嫌重大飞行事故罪,如何审理及作出判决,对此类犯罪将起到判例的作用。


  去年公布的事故调查组的报告还认定,深圳航空(河南航空的母公司——编者注)对河南航空投入不足、管理不力;河南航空安全管理薄弱;有关民航管理机构监管不到位;民航中南地区空中交通管理局安全管理存在漏洞。


  数名“8·24”伊春空难的伤者到庭旁听案件审理,他们表示索赔问题在下一步的考虑计划中。


  2004年11月24日包头空难发生后,其索赔案去年底在北京市第二中级法院进入实质性审理阶段,32名遇难者的家属起诉东方航空公司和东航集团以及飞机制造商、发动机制造商,提出索赔1.32亿余元。据记者了解,该案后以调解告终。


  2010年8月24日21时38分,河南航空有限公司E190机型B3130号飞机执行哈尔滨至伊春VD8387定期客运航班时,在伊春市林都机场进近着陆过程中失事,造成机上44人死亡、52人受伤,直接经济损失30891万元。
