  郭万里:农药在身上,(车主)拿了(农药)说,你要不让我过,我就死给你看。(路政执法人员)说,那你死,你死跟我们没关系。


  郭万里说,听到执法人员的说法,温丽毫不犹豫地打开瓶子,喝下了农药。此时也闻讯赶来的车主家人赶紧夺下农药瓶,寻求救援。


  刘怀洲:你抓紧把我妹送到医院吧,我妹都喝过药了,(路政执法人员)当时说的,你喝药跟我没关系,有事你找领导去,当时我妹妹情况不好,姓季的下车就跑了。


  刘怀洲说,他妹妹喝农药事件发生后,当时路政部门在场的几位负责人立刻开车走了,现场的执法车也拒绝送人去医院。他们最后还是打“120”叫来救护车,才将妹妹温丽送到医院抢救。那么当时现场到底发生了什么呢?《经济半小时》记者找到当事的另一方,当地路政部门进行解。经过反复沟通,永城市公路局路政大队大队长高永福最终接受了采访,但高永福表示,事情并不是这样的。


  高永福:跟他反映的情况不是一回事。那不是月票,它是,咱没有。我不知道月票什么概念。罚过了,你再超载,还会罚你,对不对。咱就跟车主反复的做工作,你车辆违章超载,一直在劝解。我们工作人员就把药瓶子夺下来了,夺下来以后,把车主给拖一边去了。


  《经济半小时》记者:当时执法人员有没有送她去医院?


  高永福:不知道车主喝药。没人知道她喝药。


  《经济半小时》记者:人家明明都说出来了。


  高永福:那是车主说的,这只是她说的。


  路政部门的执法人员表示,超载处罚是正常执法,而且当时他们并不清楚车主有服毒的行为。这与车主一方所说的情况显然不一致。同时,对于郭万里他们提出的,在执法过程中没有直接放行或者处理,而是又打电话叫来路政执法人员参与处罚的说法,高永福也不认同。


  《经济半小时》记者:为什么把你们叫过去呢?


  河南永城市公路局路政大队大队长高永福:我们是治理超载主体,毕竟我们检测,去实施处罚。咱这每次违章,都要进行监测、处罚、分流、放行,这是咱程序。


  《经济半小时》记者了解到,在永城,公路运输一直是由多个部门在管理。运政,是交通局管辖,主要管客运、货运车辆本身,比如车辆本身是否改装等。路政,则是由公路局管辖,主要管公路运输,车辆是否超载,对道路、运输是否带来安全危害等等。那么,当地路政、运政部门究竟是如何执法的?他们设立的超限检测站,平时又是如何治理超载超重的呢?记者决定跟着一名熟悉当地情况的货车司机进行一次体验。货车司机告诉记者,离永城市区6、7公里的地方,有一个叫高庄超限检测站,是运政部门设立的,司机反映强烈。《经济半小时》记者在现场仔细观察后发现,一些涉嫌超载的大货车路过这家超限检测站时,要么从检测站旁边的一条乡村公路绕道过去,根本不进检测站;要么,即使进了检测站,几分钟后,货车又开出来继续上路。是这些车都没超载吗,还是这个超载检测站里另有门道,随后,记者随着一名货车司机来到检测站里。


  超限检测站工作人员:如果不超65(吨),可以从轻处罚,如果超65(吨)肯定处罚。


  货车司机:肯定不超65,不卸(货)你要讲。


  工作人员:我刚才说了,如果是化工燃料,可以不卸货,可以照顾你。(每辆车交)200(元)。


  原来,只要交200元罚款,即使超载也可以继续上路行驶。长期与这个行业打交道的一名货车司机说,超限检测站一直是这么做的。货车维权司机王金伍曾对永城当地的公路管理状况进行过多次调查了解,他说,其实类似的问题比较普遍。


  维权司机王金伍:咱们从2006年,处理超限到现在,治理超限9年,我感觉现在最大的问题,并不是说货车(超限减少)了,而且治超限的本身,治超限的本身,人员队伍庞大,据我了解,有些县级,治超队伍大于100人。按照交通部的标准,一个超限站只有45个人,所以说它这个治超队伍庞大,它的经费来源靠罚款,罚款返款。罚款多了,它可以,这个单位福利好了,待遇好了,就是靠这个。


  那位女车主和她的货车当时到底遭遇了什么,由于当事人眼下还在医院抢救,只能等待下一步相关部门的介入和调查。不过有一点可以确定,路政有关负责人强调的按程序执法和调查到的给200元就放行形成了鲜明对比。永城公路执法人员到底有多少人,罚款和工资待遇之间是什么关系?


  河南永城公路执法一笔糊涂账


  是不是真的像那些车主们所反映的那样,执法人员严重超编,运行费用全依靠罚款?《经济半小时》记者对永城运政、路政执法人员数量进行了调查核实。


  河南省永城市公路局法制办主任曹学军:执法人员是40(人),路政、包括(流动)治超(人员)。


  《经济半小时》记者:那你们这个具体是什么性质的?


  曹学军:具体性质我们也搞不清,但是我们没有临时工,全是正式工,我们全是执法人员。


  面对采访,永城公路局法制办负责人在计算了一阵后告诉《经济半小时》记者,路政执法人员总共是40人,但在路政大队负责人那里,人员又变成了另外一个数字。


  河南永城市公路局路政大队大队长高永福:按照这个政府的编制是70人,目前现在人员是42人。


  高永福说,现在路政人员是42人,和曹学军的不尽相同,但《经济半小时》记者在当地路政执法检测点偶然发现一张人员名单表,这上面人数又有变化,总共有44个人。


  《经济半小时》记者:有44个人?


  工作人员:42个人。


  《经济半小时》记者:这不是标的44个人?


  工作人员:……


  表面看,不论是40人、42人、还是44人,整体出入都不大。如果这就是永城路政的全部真实情况的话,似乎也能理解。然而,一位知情人却告诉记者,当地路政大队的人数,至少要比这些负责人告诉记者的要多一倍。


  知情人:执法大队,将近100(人)。


  《经济半小时》记者:将近100人?那怎么会有这么大差距?


  知情人:这是一个样,河南一个样。不能让其他人知道。


  为了进一步证明自己所言不虚,这位知情人士还拿出当地公路管理局通讯录,他说,光这本通讯录上面路政执法大队的人数就有48人。


  知情人:他们现在在职的,还有很多人没填写。


  那么,当地运政人员的人员情况又怎么样呢?


  河南省永城运管局副局长兼运政大队大队长刘新栋:50个人,真的,我就说执法人员这些。


  刘新栋告诉《经济半小时》记者,这50个人,他是凭记忆说的,具体人数多少,需要找财会人员,此时,记者提出想看看人员花名册,但是直到记者采访离开,没有见到相关的财会人员,也没看到人员花名册,当地运政执法人员究竟有多少人,仍然没有人能说清楚。那么不论是多少人,人员工资、办公费用等来源又是什么呢?


  《经济半小时》记者:那怎么解决(人员收入)资金?


  刘新栋:上面拨资金,也就400多万(元)。


  《经济半小时》记者:能解决多少人(收入)?


  刘新栋:这个所以说,就是很大的问题,现在有多少,我们真的去罚,能保证多少,能保证多少。


  《经济半小时》记者:一年……罚了多少钱?


  刘新栋:这个……,我没有参与。


  《经济半小时》记者:超限站一年收费多少呢?


  曹学军:超限(罚款),一年大概是收300多万(元),这个钱我们也不问。


  知情人:经费,现在全部从这个,在他们执法这个过程中,这些罚款,罚100块钱,返(还)给(执法人员)70块钱好处费,然后(合)一块,然后决定怎么分,怎么罚。


  《经济半小时》记者:这个有没有相关的单据?


  知情人:这个单据,你要(去)财政部门,是不允许你随便乱看的。一个(财务)制度管理,不让用,一般是不会让你看的。所以他们指这个,你也查不到,他们就这样弄。


  《经济半小时》记者对永城路政、运政两个部门采访了两天,但最终,对当地路政、运政执法大队究竟有多少人,每年经费多少,“治超”罚款多少,罚款是否返还,两个单位的有关负责人也没能给出明确答案。但常在这一带跑的货车司机、车主们告诉记者,在这里,他们被迫常年购买运政、路政罚款年票、月票来为车辆买“保险”,但是,有时候这种“保险”也不保险。11月14日下午,目睹自己车主喝农药自杀的货车司机郭万里告诉记者,车主温丽之所以拿命相搏,并不仅仅是为了当天的罚款,还有一个重要原因就是,上个月他们才被罚了。


  郭万里 :我们(车主)气得确实不行,因为上个月刚在那边,(被)罚了好几万(元),这次心里面承受不了。


  郭万里说,尽管他们都按时购买了年票月票,但就像当天发生的事情一样,要罚就罚,根本没有商量的余地,所以,才出现了本节目开头提到的车主以命相拼的极端个案。就在《经济半小时》记者调查的过程中,又接到群众反映,路政部门的执法车辆本身就存在违法使用问题。


  《经济半小时》记者:你看,他说这个车,查询了解,是到2009年,违法未处理,那现在都2013年了,怎么还在使用?


  河南省永城市道路运输管理局书记:具体这个情况,我不太了解。


  《经济半小时》记者:那这个怎么理解,就说这个东西,这执法车是一种,本身就是违法的。

  《经济半小时》记者:那怎么还在使用执法车呢?


  河南省永城市道路运输管理局书记:现在没车。


  《经济半小时》记者:像这种车有几辆车?


  河南省永城市道路运输管理局书记:三个车。


  对于自己部门的人员和财务说不清楚,我们不敢肯定这些部门负责人是真糊涂还是装糊涂。在全国,类似永城这样的地方还有多少,究竟有没有可能告别公路三乱?在地处河南、安徽、江苏、山东四省交界的河南永城,《经济半小时》记者遇到了一系列奇怪的现象,超取站收200元就随意放行,管理人员面对镜头却强调他们按程序处罚;知情人反映罚款70%返还,负责人却推脱说帐目不清楚,无从查起。事实上,永城存在的问题并不是个例。


  三、公路超治难以根治的原因


  对于公路“治超”为何难以根治的主要原因?在这个行业摸爬滚打10来年的货车司机王金伍指出,根本原因就是现有体制造成的,涉及治理“三乱”的有关部门就有十几个,包括交警、运政、路政、城管、环境、卫生、林业、盐业、质检、工商等,由于政出多门、各部门虽都有法可依,但处罚标准、金额多少又不一样,这种情况下,货车司机压力很大。为此他结合自己的感受体验专门写一篇文章,还请人画了一幅漫画。


  王金伍:各有各的标准,罚款从2千到10万不等。城管是2万以下,运管是10万以下,收费站16倍。交叉管理。比如说车辆,现在车辆,我们买的货车,按照交通安全法的规定,我们办理行驶证,就可以上路行使了。但是事实不是那样,按照道路运输条例,你办一个运营证,不办,是10万元以下罚款。你遵守了公路法,违反了交通安全法,你尊重交通安全法,你不一定遵守道路运输条例,你遵守道路运输条例,你不一定遵守城市道路条例,所以说只要在(多个部门管理)部分,政府(多部门管理)部分,货车司机,你早晚都是违法。


  采访中,负气喝农药的温丽的哥哥介绍,他们兄妹俩2013年4月,共同出资贷款买了这两辆货车,每辆车30多万元,共60多万元,贷款首付20多万元,每月需还贷2万多元,被扣的货车是其中一辆,从4月买车到现在,跑运输也就半年多的时间,但他们光罚款就相当于这两辆车的首付了。


  车主温丽的哥哥刘怀洲:连公路加交通,截至到现在,将近花了20万(元)。


  《经济半小时》记者:都是哪些罚的?


  刘怀洲:河南的,有时候罚好几万(元)。


  《经济半小时》记者:有几张单子?


  刘怀洲:这是四张单子。


  《经济半小时》记者:其它单子呢?


  刘怀洲:有的找不着了,这是返回时候的票,其它的找不着了。这个是一万两千多的,这个是两万五(千元)的,都看不清了。现在罚得我,车都没法跑。10月份的贷款我都没交,这11月份的也没交,这两个月的贷款我都没交。


  温丽的哥哥介绍,温丽跟车当天,兜里总共就只有300多块钱,还是他和司机在路上的饭钱,被罚款罚怕了温丽最终选择不交罚款,喝农药。尽管这件事可以看作是一个个案,但是公路治超和公路三乱问题的确是当今发展物流业怎么也迈不过去的坎。那么,怎么有效地解决超载超限问题?同样也是道路管理部门的永城交警,还有货运司机,从各自的角度提出了自己的建议。


  永城市公安局交警大队教导员聂士亮:你包括联合治超,这个加大,但这只是一个指标不治本,但是要治本,从源头上治理,地点就是这些,这些(超载)车辆,从哪里来,从哪里来的,咱们找源头。(生产)厂家这方面,要做到,就是车辆(符合标准),这是这一点。第二个咱们要是建议有关部门,针对整改这些,特别是大货车的改装进行治理。


  维权司机王金伍:要从源头把这个单一超限、卸货制止住,而现在的管理,什么部门也管,结果是各有各的标准,如果这个标准都执行的话,货车根本生存不下去,这些执法部门也知道,标准不一,但是它们各按各的标准,它们只顾自己的罚的款而已,其余治理超限,是做样子的。


  查扣在路边的货车


  11月26日,《经济半小时》记者离开永城时,被查扣的车主温丽的货车,仍然停在事发现场,已经10多天了,当地两辆路政执法车一前一后堵在公路上,负责看守的几名执法人员,日夜轮流守侯,吃睡都在车上。


  【半小时观察】


  虽然最终也没能看到详细人员帐目清单,但从我们多年报道的判断看,即使全部如实公开,河南永城公路部门其实也不会有什么太大秘密,不外是又一个以罚代管,罚款返还的案例。这些年,我们已见过太多类似的现象,从黑龙江的林甸县,河南省的淮滨、商丘,湖北省的公安县,所有这些地方的公路管理部门仿佛被施加了同样的“集体魔咒”,而事实上,如果我们再往前一步,会发现,公路管理部门遭遇的实际是体制魔咒,2009年全国范围内的燃油税费改革后,一系列没有完善的配套问题在相当程度上导致了这一切。如何破解公路三乱?答案已经非常清晰,除了全面落实行政执法责任制和执法经费由财政保障制度外,更关键的是破除部门藩篱,依靠一纸文件或部门规章就可以随意处罚的状况必须得到改变。十八届三中全会已明确提出:整合执法主体,相对集中执法权,推进综合执法,着力解决权责交叉、多头执法问题,建立权责统一、权威高效的行政执法体制。我们期待着,公路主管部门能真正落实三中全会要求,先行先试,在公路管理执法方面取得重大突破。
