　　检方指控，案发现场位于朝阳区东坝北路，为南北双向并有社会车辆通行的社会道路。8月24日23时许，犯罪嫌疑人刘某(男，驾驶尚酷牌机动车)、杨某(男，驾驶宝马牌机动车)、徐某(男，驾驶宝马牌机动车)分别驾车行驶至此处，次日凌晨1时许，当他们观看别人比赛后，也想参加竞驶。杨某、徐某将车辆驾驶至道路中黄色隔离线两侧同一起点，追逐竞驶后返回。后杨某、徐某决定再一次比拼，而刘某认为自己所驾车辆与杨某、徐某所驾车辆性能相差无几，也加入飙车行列，三车追逐竞驶后返回。

　　检方透露，三人到案后对于驾车追逐竞驶的犯罪事实供认不讳，但三人均表示只是出于好奇心理才参与其中，对飙车行为的危害性认识不足，没想到其行为有如此严重的后果。

　　根据我国刑法一百三十三条规定，在道路上驾驶机动车追逐竞驶，情节恶劣的，或者在道路上醉酒驾驶机动车的，处拘役，并处罚金。
