据新华社电自12月1日起，《湖南省国家赔偿费用管理办法》正式实施。新办法对实践操作中国家赔偿费用预算不足、支付期限过长、追偿流于形式，以及国家赔偿被“私了”等问题，作出了具体规制。
办法指出，赔偿请求人申请支付国家赔偿费用，应当提交生效的判决书、复议决定书、赔偿决定书或者调解书，以及赔偿请求人的身份证明和银行账号。赔偿义务机关收到申请即为受理，并书面通知赔偿请求人。申请材料不完整的，赔偿义务机关应当当场或者在3个工作日之内一次告知赔偿请求需要补正的全部材料。
办法还规定，请求人从提出申请到获得国家赔偿费用最长不超过22天；财政部门接到赔偿义务机关申请后15日内将国家赔偿费用直接支付给赔偿请求人。
作为配套的制度，由湖南省财政厅发布的《湖南省财政部门国家赔偿费用申请受理支付办法》将与新办法同步实施；自1997年开始实施的《湖南省实施〈国家赔偿费用管理办法〉规定》同时废止。
值得关注的是，与此前的规定要求不同，国家赔偿损失费用支付由原来“赔偿义务机关先从本单位预算经费和留归本单位使用的资金中支付，支付后3个月内再由赔偿义务机关按照程序向同级财政机关申请核拨”的方式，转变为“财政部门的工作职责由审核后及时核拨转变为接到赔偿义务机关申请后按时支付”，从而有效避免了某些部门为了避免被追究责任而与受害人“私了”的现象。
