庞业文说，11月份的照片中，摆出手势与段新德合影的俩人，分别是临澧县信访局干部和当地社区的治安主任，“我已经批评他们了，我们局那个工作人员现在正在休假。”
对于为何要拍照片，庞业文说，当时这些工作人员跟段新德吃住在一起有10多天，彼此都非常熟悉，在医院为段新德检查身体时，得知他的癌细胞已经减少有好转趋势，后来大家又得知当天下午6点就可以接段新德回家后，一时高兴就拍下了这样的照片。
但段新德并不认同庞业文的说法，“你看照片中我的脸色，我能高兴的起来吗？”
