社会抚养费从未主动公开
社会抚养费，早年被称为超生罚款或计划外生育罚款，与我国的计划生育制度伴生。
2002年，国务院《社会抚养费征收管理办法》明确，社会抚养费是指为调节自然资源的利用和保护环境，适当补偿政府的社会事业公共投入的经费，而对不符合法定条件生育子女的公民征收的费用。
根据这一定义，律师吴有水认为，社会抚养费应用于“补偿政府的社会事业公共投入”，其收支情况无疑应向社会公开。
然而多年来，各级计生、财政部门从未主动向社会公开过社会抚养费的收支情况。今年9月，国家审计署首次明确表示，对社会抚养费关注度不够，近年来未组织过全面审计，也未能全面掌握这些资金底数。
江苏广东计生委被起诉后陆续公开
公民申请政府公开社会抚养费信息的过程并不顺利。最近两个公开社会抚养费征收总额的江苏省人口计生委和广东省卫生计生委(9月底前是广东省人口计生委)，都曾明确拒绝公开社会抚养费的相关信息，理由是“申请人申请公开与本人生产、生活、科研等特殊需求无关的政府信息”。
为此，吴有水将江苏、广东两省计生部门诉至法庭。本月初，在法庭受理此案的背景下，江苏省人口计生委通过协商方式，向吴有水“口头”公布了江苏省2012年度社会抚养费征收总额为12亿。
在广东，广州市越秀区人民法院和广州市中院，对吴有水的起诉均拒绝立案。12月2日，广州市政协委员韩志鹏向广东省卫计委、省财厅、省审计厅快递了《关于公开广东省2012年度社会抚养费收支及审计情况的申请》，加入追问社会抚养费收支情况的行列。两天后，广东省卫生计生委选择直接向社会通报2012年度社会抚养费征收总额：14.56亿。
在昨日的通报中，广东省卫生计生委还表示，该省的社会抚养费征收由相关部门统一征收，所征收的社会抚养费统一交至当地财政指定的专用账户，纳入当地财政统筹使用。该省各级人口计生部门工作所需的经费由财政予以保障，纳入年度财政预算，与社会抚养费没有直接对应关系。
计生财政部门不掌握支出情况，律师称失职
11月1日，国家卫生计生委官网通告，要求辽宁、安徽、江西、山东、海南、重庆、甘肃7省人口计生委限期向吴有水公开该省2012年度社会抚养费的收支情况信息。
这是我国实行计划生育政策以来，主管部门首次对社会抚养费应否公开、应如何公开等问题，作出明确表态。
然而至今，尚无一省份计生或财政部门公开支出情况。多数部门给出的不公开理由是，“社会抚养费由县级人民政府计划生育部门或者委托乡(镇)人民政府和街道办事处征收，上缴县级国库，纳入县级财政预算管理，由财政部门统一安排使用，收入和支出不挂钩。因此，省级部门不掌握2012年度社会抚养费实际开支情况”。
吴有水认为，社会抚养费的征收标准混乱，“相信省级计生委、财政厅确实不掌握该省的社会抚养费收支明细，但这也恰恰说明他们的失职，巨额社会抚养费的收支一直失于监管”。
