南方农村报-新牧网讯(记者何觅之) 广东省各地市从2010年开始陆续制定了行政处罚自由裁量量化标准，但大多都是试行版。据广东省农业厅政策法规处副处长肖加裕介绍，目前广东各地市试行版进行修改调整的规划尚不明确，也没有间规划表，是否需要修订，要根据各地市的具体情况来确定。“因为根据各地市情况不一样，对于自由裁量权的衡量标准，各地市可以根据实际情况确定，裁量时分两种或两种以上的情况考虑，或者直接以数字量化标准，标准也都在可接受的范围内。”
据了解，江门市农业局此次公布行政处罚自由裁量量化标准在2010年就已制定，而东莞市、佛山市等也相继出台了相关标准。《广东省规范行政处罚自由裁量权规定》于2012年1月1日正式实施，要求广东省各地市行政处罚主管部门制定相关处罚量化标准，从而催促了该行政处罚自由裁量量化标准的推行，各地市可以根据实际情况，制定相应的处罚标准。

近日，江门市农业局对2010年制定的《江门市农业局行政处罚自由裁量量化标准》进行了调整和修改。比对各地出台的自由裁量权量化标准，记者发现，江门多采用累计违法次数来衡量违法程度和决定处罚数额；肇庆更则偏向于用累计违法次数及所造成的后果来双向判断，而2010年出台的佛山市行政处罚自由裁量量化标准则并未细分处罚情况。

与江门相比，肇庆在这方面的处罚就比较“温柔”，肇庆市畜牧兽医局将违反动物防疫法七十五条的规定的情节分为四种，其中有两次或者两次以上扔死猪尸体等违反规定的行为才会被处1000元以下罚款。
而佛山市规定，不按照规定无害化处理染疫动物及其产品的，对违法行为单位处以3000元罚款，对违法行为个人处以1000元罚款。
中山对此项行为，则规定“经教育能立即停止违法行为，并主动采取有效措施，按规定无害化处理的，不予罚款；经教育虽能停止违法行为，但不主动采取措施处置的，由动物卫生监督机构责令无害化处理，所需处理费用由违法行为人承担，并处1000元罚款；经教育不停止违法行为，或因违反本条规定被处罚2次以上的，由动物卫生监督机构责令无害化处理，所需处理费用由违法行为人承担，并处3000元罚款。”
违规销售兽药◥＞
最高罚20万
根据新标准，江门市对生产、经营假、劣兽药而造成严重危害的，或者兽药经营企业经营人用药品的，最高可罚款20万元。
据了解，按照《兽药管理条例》第五十六条的规定，上述行为最高可处以20万元以下罚款。在中山市、佛山市农业局行政处罚自由裁量量化标准中，对违法生产、销售假、劣兽药，最高处以15万元罚金，而肇庆市对违法该条例的处罚力度也较大，可处以违法生产、经营的兽药(包括已出售的和未出售的兽药)货值金额4倍以上5倍以下罚款，货值金额无法查证核实的，处10万元以上20万元以下罚款。
此外，《兽药管理条例》第六十六条规定：“未经兽医开具处方销售、购买、使用兽用处方药的，责令其限期改正，没收违法所得，并处5万元以下罚款；给他人造成损失的，依法承担赔偿责任。”据悉，在目前的的行政处罚规定中，佛山市对开具处方销售兽用处方药的，除没收违法所得，还将处以3—5万元罚款；对使用兽用处方药的，首次处1000元罚款，二次以上处5000元罚款。肇庆市对违反这一规定的行为，情节严重时，处3万元以上5万元以下罚款，给他人造成损失的，依法承担赔偿责任。而中山市对未经兽医开具处方销售兽用处方药的，最高处3万元罚款。令人意外的是，江门市和梅县目前对这一行为尚未做出处罚规定。
对此，肖加裕表示，广东省政府是否会根据畜牧发展情况，对其他地市做统一调整修订，目前尚无明确答案，也无统一时间。
