Honorary Director of a hospital in Chongqing sentenced in bribes many times 11.5

CNS, Zhongqing, December 5 (reporters Li Chunguang and Jiang Qinglin)-5th reporters from Chongqing banan district people's Court heard that, Honorary Director of the local hospital open bribery case trial sentencing. Accused Liang Fa (not his real name) was sentenced to 11 years and 6 months imprisonment on charges of taking bribes, and confiscation of the proceeds of 1.071 million dollars handed over to the State Treasury.

Court found that between 2003 and accused Liang Fa as a banan district during a hospital Director, Honorary Director, used for the purchase of medicines, use, management positions in proportion to get the rebate, and many received what a pharmaceutical sales, Li, Liu and others bribed a total of 1.071 million dollars.

Liang Fa the defendant argues, no objections to the indictment alleged kickbacks, but thought he was just hired by the hospital doctor, no drug purchasing power, not State officials, bribery does not constitute bribery but non-State officials on corruption charges.

Court concluded that Liang Fa of advantage for the benefit of others, will receive a huge bribe, constitute the crime of taking bribes, then made the above verdict according to the law.

　　中新网重庆12月5日电 (李春光 蒋青琳) 记者5日从重庆巴南区人民法院获悉，当地一医院内科室名誉主任受贿案一审公开宣判。被告人梁发(化名)以受贿罪被判处有期徒刑11年6个月，并没收赃款107.1万元上缴国库。

　　法院审理查明，2003年至2013年，被告人梁发在担任重庆市巴南区某医院内一科主任、名誉主任期间，利用对药品请购、使用、管理的职务便利按比例得到回扣，且多次收受药品销售人员何某、李某、刘某等人贿赂总计107.1万元。

　　被告人梁发辩称，对起诉书指控的收受回扣事实无异议，但认为自己只是医院聘请的医生，无药品采购权，不是国家工作人员，其受贿行为不构成受贿罪而是非国家工作人员受贿罪。

　　法院审理后认为，梁发利用职务之便为他人谋取利益，收受他人巨额贿赂，构成受贿罪，遂依法作出上述判决。
