北京市隆安律师事务所律师尹富强认为，事件中外籍男子违反交通规则后撞人，对被撞者造成人身损害，属于人身损害侵权。
对照片拍摄者而言，由于其图片描述歪曲事实，损害了他人的名誉，也属于侵权行为。被侵权人有权通过诉讼等方式维护自身权益，也有权放弃维权或者选择调解。尹富强称，此类诉讼维权成本高昂，多以调解结束。
