重庆五中院经审理查明：2005年至2008年间，被告人宋薇先后利用担任自来水公司副经理及负责实施沙坪坝水厂改造工程的沙坪坝水厂建设办公室主任、水厂改扩建办公室主任的职务便利，接受重庆市迎龙建筑工程有限公司股东、重庆北瀚园林绿化工程有限公司法定代表人赵行伦的请托，为迎龙建筑公司承接沙坪坝水厂改造项目的劳务分包工程、玄坛庙水厂改扩建应急供水项目的劳务分包工程，以及北瀚园林公司承接沙坪坝水厂改造园林绿化工程等事项提供了帮助。为此，宋薇于2007年2月至2008年7月先后5次通过其使用的赵行伦名下的银行借记卡收受赵行伦所送的70万元，用于日常消费等支出。
2010年至2011年，被告人宋薇利用担任重庆水务集团白洋滩水厂建设办公室主任、两江水务执行董事、总经理职务上的便利，接受赵行伦的请托，为赵行伦挂靠的重庆城鹏建筑工程有限公司承接白洋滩水厂净水厂区平基土石方及挡墙附属项目的分包工程、协调降低工程管理费、协调除渣倾倒场地等事项提供了帮助。为此，宋薇于2011年10月至2012年3月间，先后13次通过其使用的梁容名下的银行卡收受赵行伦所送的好处费205万元，用于个人炒股等用途。
2010年至2011年，被告人宋薇利用担任重庆水务集团白洋滩水厂建设办公室主任、两江水务执行董事、总经理职务的便利，接受建筑承包商范家荣的请托，为范家荣组织的施工队伍承接白洋滩水厂一期取水部分土石方分包工程、协调除渣倾倒场地等事项提供了帮助；为范家荣挂靠的江苏省第一建筑安装有限公司重庆分公司承接龙兴水厂改扩建项目的劳务分包工程等事项提供了帮助。为此，宋薇于2011年12月6日、2012年1月21日先后二次通过其使用的梁容名下的银行卡收受范家荣所送的好处费共计100万元。
2011年至2012年，被告人宋薇利用担任重庆两江水务有限公司法定代表人、执行董事、总经理职务的便利，接受重庆合鼎建材有限公司经营者游燕华的请托，为该公司向龙兴水厂改扩建项目部、白洋滩水厂工程项目部销售瓷砖提供帮助。2011年8月至2012年5月期间，宋薇先后5次通过其使用的赵行伦名下的银行卡收受游燕华所送的好处费15.3万元。
法院审理期间，宋薇的亲属代其退缴赃款390.3万元。
重庆五中院认为，被告人宋薇身为国有公司委派到非国有公司从事公务的国家工作人员，利用职务之便为他人谋取利益，非法收受他人财物共计390.3万元，其行为已构成受贿罪。鉴于宋薇归案后如实供述了自己的犯罪事实，包括司法机关尚未掌握线索的同种罪行，其间虽有翻供，但尚能在庭审结束前诚恳认罪，并积极退清全部赃款，可酌情予以从轻处罚。综上，法院作出如上判决。
