东兴市法院审理查明，2012年12月7日上午7时许，南宁海关执法人员驾驶的海关执法车在东兴市东兴镇解放东路兴宁市场附近执法缉私时，与黄某华驾驶的装有冻货的摩托车发生碰撞。随后，东兴警方赶到现场处置该起交通事故。
法院审理查明，在处置上述交通事故的过程中，现场有部分滋事者阻挠执法人员执法，并围攻公安、海关执法人员及车辆。在警方及海关的增援人员及车辆赶到现场后，部分现场滋事者以起哄、冲击维护现场秩序的警员，打、砸、烧警车等方式闹事，造成数千名民众现场围观，导致街道堵塞，现场秩序严重混乱。整个过程持续约10小时，直至当日下午事态才得到控制。
2012年12月24日，涉案的11名嫌疑人被东兴警方刑事拘留。今年10月31日，公诉机关以寻衅滋事罪向东兴市法院提起公诉。
法院审理查明，上述事件造成多名在现场维持秩序的警员受伤，10辆海关执法车不同程度损坏，其中3辆执法车被焚毁，造成直接经济损失76万余元人民币。
法院审理认为，11名被告人在公共场所起哄闹事，随意殴打他人，情节恶劣，故意损毁公私财物，情节严重，造成公共场所秩序严重混乱，行为均已构成寻衅滋事罪。(完)
