历时近两年，百度诉360不正当竞争案作出终审宣判。记者昨天获悉，北京市高院维持一审原判，认定360不正当竞争行为成立，赔偿百度40万元。

2012年初，360安全卫士推出“搜索保镖”功能，帮助用户在搜索网页时一定程度上识别恶意链接。由此，百度以360未经允许恶意标注百度搜索结果、篡改百度搜索结果页面为由，将其诉至法院。后一审法院判决360不正当竞争行为成立，判赔百度经济损失45万元。随后，360认为一审法院在不了解安全软件工作原理的情况下作出错误认定，并坚称在网站上标注安全标识是出于用户需求，由此提出上诉。

今年9月，该案在北京市高院二审开庭。最终，经审理，法院作出终审判决，认为360虽“在搜索结果网页上插标具有一定公益性”，但“没有证据显示插标行为是保护网民免受虚假信息的必要手段”，且“干扰他人互联网产品或服务的正常运行，并非出于保护公共利益的目的，也不产生保护公共利益的效果”。故维持一审原判，赔偿百度40万元。

对于这一结果，百度方面表示满意。360方面则表示尊重判决。
