近日，中共湖南省委通报了衡阳破坏选举案的调查处理情况。经调查认定，衡阳破坏选举案是一起严重的以贿赂手段破坏选举的违纪违法案件。12月28日，省人大常委会召开全体会议，依照《中华人民共和国全国人民代表大会和地方各级人民代表大会选举法》和《中华人民共和国全国人民代表大会和地方各级人民代表大会代表法》，对通过贿赂手段当选的省人大代表，依法确认并公告其当选无效；对未送钱拉票但工作严重失职的省人大代表，依法公告其代表资格终止；鉴于衡阳市人大常委会组成人员涉案面广，已经无法正常履行工作职责，决定成立衡阳市第十四届人大第三次会议筹备组，授权筹备组依法行使相关职权。同日，衡阳市第十四届人大第三次会议筹备组以及衡阳市所辖县、市、区人大常委会分别召开会议，对收受钱物的衡阳市人大代表，依法终止其代表资格并公告。
2012年12月28日至2013年1月3日，衡阳市召开第十四届人民代表大会第一次会议，出席会议的代表527名(本届人民代表大会共有529名代表，有2名代表因故未出席会议)，从93名代表候选人中差额选举产生76名省人大代表。会议期间，部分候选人为当选省人大代表送钱拉票，造成对代表选举工作的严重破坏。从2013年2月开始，就有群众陆续向中央有关部门、省委及相关部门举报，引起了省委的高度重视。省委随即要求省纪委调查。省纪委经过初步调查，获取了部分市人大代表在市人大会议期间收受省人大代表候选人送钱送物的情况和证据。
4月上旬，省委听取了案件初步调查情况汇报，认为案情重大，性质严重，必须彻底查清，给社会一个交代、给人民一个交代；要求办案机关一定要以事实为根据，以法律为准绳，坚决严肃、扎实稳妥地做好案件查处工作，把此案办成经得起人民和历史检验的铁案。省委成立了由省委主要领导任组长的衡阳破坏选举案调查处理工作领导小组，省纪委成立了专案组。
6月中旬，专案组赴衡阳市开展全面调查，获取了大量书证、物证，基本查清了案件事实：衡阳破坏选举案共有56名当选的省人大代表存在送钱拉票的行为，涉案金额达1.1亿余元人民币，有518名衡阳市人大代表和68名工作人员收受钱物。涉案钱物已退缴到位。
根据案件事实和情节，省有关方面依法依纪作出决定：对56名送钱拉票当选的省人大代表依法确认并公告当选无效，对5名未送钱拉票但工作严重失职的省人大代表依法公告其代表资格终止；对512名收钱的市人大代表和3名未收受钱物但工作严重失职的市人大代表由衡阳有关方面依法终止代表资格(注：另有6名收受钱物的市人大代表此前因调离本行政区域已经终止代表资格)；对涉案的党员和国家工作人员，依照《中国共产党纪律处分条例》和《行政机关公务员处分条例》进行党纪政纪立案调查；对涉嫌犯罪的，移送司法机关审查。在案件进一步调查中，如发现有其他人员涉嫌犯罪的，也将依法移送司法机关处理。
省委强调，衡阳破坏选举案涉案人员多，涉案金额大，性质严重、影响恶劣。这起案件是对我国人民代表大会制度的挑战，是对社会主义民主政治的挑战，是对国家法律和党的纪律的挑战，必须依法依纪严肃查处。省委要求，全省各级各部门要统一思想，深刻反思案件教训，剖析问题根源，探究治本之策，坚决防止类似案件重演。
