　　法院审理后认为，2013年7月17日上午，被告人廖卫昌、袁城、骆威平、夏际玉在行政执法过程中与邓正加夫妇发生争执，因邓正加妻子黄某谩骂行政执法人员，且邓正加用秤杆戳向廖卫昌，四被告便上前对邓正加进行殴打，诱发邓正加小脑与脑干桥延沟交汇处畸形血管破裂，蛛网膜下腔广泛出血而死亡，四被告人的行为均已构成故意伤害罪。

　　在共同故意伤害犯罪中，廖卫昌、袁城起主要作用，系主犯；骆威平、夏际玉起次要作用，系从犯。

　　案发后，四被告人主动到公安机关投案，并如实供述自己的罪行，均系自首。

　　鉴于被害人死亡的直接原因是畸形脑血管破裂致蛛网膜下腔广泛出血死亡，四被告人的伤害行为是导致畸形脑血管破裂的诱因，结合四被告人的自首情节及本案中所起的作用，依法对廖卫昌予以从轻处罚，对袁城、骆威平、夏际玉予以减轻处罚。(完)
