律师解释：警察随意开枪没有法律依据
对于陵水公安局祖关派出所无搜查证进民宅搜查和开枪的行为是否合法的问题，记者采访了法立信(琼海)律师事务所资深律师邱金福先生。邱先生依法对祖关派出所胡所长一行的执法过程和行为进行了分析。邱律师认为：
对于进入住宅是否需要搜查令的问题，依据《中华人民共和国刑事诉讼法》第一百三十四条为了收集犯罪证据、查获犯罪人，侦查人员可以对犯罪嫌疑人以及可能隐藏罪犯或者犯罪证据的人的身体、物品、住处和其他有关的地方进行搜查。 第一百三十六条进行搜查，必须向被搜查人出示搜查证。 在执行逮捕、拘留的时候，遇有紧急情况，不另用搜查证也可以进行搜查。所以侦查人员在办理案件过程中需要搜查，如果不属于紧急情况应该出示搜查证。
关于向被搜查人房屋墙上开枪的问题，根据《中华人民共和国警察法》第十条规定：遇有拒捕、暴乱、越狱、抢夺枪支或者其他暴力行为的紧急情况，公安机关的人民警察依照国家有关规定可以使用武器。《中华人民共和国人民警察使用警械和武器条例》第九条规定：人民警察判明有下列暴力犯罪行为的紧急情形之一，经警告无效的，可以使用武器：
(一)放火、决水、爆炸等严重危害公共安全的；
(二)劫持航空器、船舰、火车、机动车或者驾驶车、船等机动交通工具，故意危害公共安全的；
(三)抢夺、抢劫枪支弹药、爆炸、剧毒等危险物品，严重危害公共安全的；
(四)使用枪支、爆炸、剧毒等危险物品实施犯罪或者以使用枪支、爆炸、剧毒等危险物品相威胁实施犯罪的；
(五)破坏军事、通讯、交通、能源、防险等重要设施，足以对公共安全造成严重、紧迫危险的；
(六)实施凶杀、劫持人质等暴力行为，危及公民生命安全的；
(七)国家规定的警卫、守卫、警戒的对象和目标受到暴力袭击、破坏或者有受到暴力袭击、破坏的紧迫危险的；
(八)结伙抢劫或者持械抢劫公私财物的；
(九)聚众械斗、暴乱等严重破坏社会治安秩序，用其他方法不能制止的；

所以如不存在紧急情况，警察随意开枪是没有法律依据的。
