昨天上午9点，永兴县法院开庭审理此案，临武县城管局4名工作人员廖卫昌、袁城、骆威平和夏际玉作为被告人出庭。庭审现场共有60人旁听，包括死亡瓜农邓正加以及城管的家属代表。邓正加的儿子邓青强说，在庭上，他见到了涉事城管的家属，“我们没有说话”。
庭审过程中，被告人究竟是“故意伤害”还是“过失致人死亡”成为控辩双方辩论的焦点。公诉方共提供6组证据，包括尸检报告、逮捕令以及一些文字材料。尸检报告称，邓正加系因为外力作用，诱发了脑部的畸形血管破裂出血死亡。对于该报告，4名涉事城管并没有提出过多的疑义。
昨天下午3点，永兴县法院经过审理，以故意伤害罪宣布判处临武县城管局工作人员廖卫昌有期徒刑11年，袁城、骆威平、夏际玉有期徒刑6年、4年和3年6个月。
邓正加的儿子、二哥以及外甥旁听了此次庭审，其子邓青强表示不满意。邓青强认为，由于被告导致其父亲死亡，“1个人判11年，其他人都不到10年，我觉得非常不公平”。邓青强称，希望法院能够对被告人从重处罚，“我们就希望一命抵一命”。
今年7月17日，临武县城市管理行政执法局工作人员在执法过程中，与该县南强镇莲塘村村民邓正加夫妇发生冲突，邓正加倒地身亡。事发后，涉事城管局工作人员被刑拘，城管局局长胡郴、党组副书记邹红卫被免职。7月18日，郴州市公安局法医对邓正加的尸体进行了检验。7月30日，郴州市公安局法医根据尸体检验情况及中山大学法医鉴定中心病理组织学检验结论综合分析认为，临武瓜农邓正加系外力作用诱发脑部畸形血管破裂出血死亡。
据法院查明，案发后被告人廖卫昌、袁城、骆威平、夏际玉主动到临武县公安局投案，并如实供述了自己的罪行。
