27日上午9时，永兴县人民法院开庭审理这一案件。在庭审现场，4名被告人廖卫昌、袁城、骆威平、夏际玉身穿黄色马甲，静坐在被告席上。媒体记者、人大代表、政协委员等60余人参加旁听。
下午3时许，法庭宣布被告人廖卫昌犯故意伤害罪被判处有期徒刑11年；被告人袁城、骆威平、夏际玉犯故意伤害罪分别被判处有期徒刑6年、4年和3年6个月。
今年7月17日，临武县城管执法人员在执法过程中，与当地瓜农邓正加夫妇发生争执，冲突中邓正加倒地死亡，这一事件广受社会关注。事发后，涉事城管局工作人员被刑拘，城管局局长胡郴、党组副书记邹红卫被免职。
事件真相还原：管理不服发生暴力冲突
经法院审理查明，2013年7月17日10时许，廖卫昌等人巡逻执法至临武县城关镇解放南路一路段时，发现邓正加夫妇未在城管划定区域内摆摊卖西瓜，在劝离未果的情况下“暂扣”了4个西瓜和一杆秤。邓正加夫妇进行阻拦，城管局工作人员告知邓正加夫妇到城管局去处理后，便离开。
当日11时许，被告人廖卫昌等人巡逻至临武大道农民自产自销指定区附近时，被转移至此摆摊卖西瓜的邓正加妻子黄某发现，黄某对廖卫昌等人谩骂。廖卫昌等人未予理睬，并到对面处理其他违规摆摊的商贩。因黄某一直对廖卫昌等人进行谩骂，廖卫昌便用手机拍摄该情况，黄某搬起西瓜作势欲砸廖卫昌，邓正加用秤杆戳向廖卫昌，廖卫昌、袁城、骆威平、夏际玉等人则一起抢夺杆秤。廖卫昌首先挥拳击打邓正加头面部，然后袁城、骆威平、夏际玉也动手对邓正加进行殴打，邓正加倒地后死亡。经法医鉴定，邓正加系在外力作用下诱发小脑与脑干桥延沟交汇处畸形血管破裂致蛛网膜下腔广泛出血而死亡。

据法院查明，案发后被告人廖卫昌、袁城、骆威平、夏际玉主动到临武县公安局投案，并如实供述了自己的罪行。
法院审理后认为，四被告人的行为均已构成故意伤害罪。在共同故意伤害犯罪中，廖卫昌、袁城起主要作用，系主犯；骆威平、夏际玉起次要作用，系从犯。案发后，四被告人主动到公安机关投案，并如实供述自己的罪行，均系自首。
鉴于被害人死亡的直接原因是畸形脑血管破裂致蛛网膜下腔广泛出血死亡，四被告人的伤害行为是导致畸形脑血管破裂的诱因，结合四被告人的自首情节及本案中所起的作用，依法对廖卫昌予以从轻处罚，对袁城、骆威平、夏际玉予以减轻处罚。
