正在研究执法细则

记者又问：关于处罚的实施细则是否还未完善？深圳市卫人委另一位负责人表示，目前已在研究执法细则。七个单位各司其职，各管一块。卫人委主导，交通运输负责公共交通工具，民航铁路管理部门负责其工具及等候场所，文体旅游负责文化、体育、旅游景点，市场监督负责餐饮及商品批发零售工作场所，公安负责校车、网吧、宾馆及酒店歌舞厅等娱乐场所，城管负责公园、地铁及其管辖公共场所。据透露，修订草案之前，深圳市卫人委已表示无法独立承担执法控烟重任。
被人称为“废话条例”
修改过两稿经过三轮审议的条例规定，除了酒吧、歌舞厅等歌舞娱乐场所，茶艺馆、按摩、洗浴(包括桑拿、水疗、水会、足浴)等休闲服务场所在2016年12月31日之前被列入限烟场所外，深圳所有室内工作场所、室内公共场所和公共交通工具内均禁止吸烟。
深圳此次条例修订稿被称为“史上最严控烟条例”：在禁烟场所吸烟且不听场所经营者、管理者劝阻的，将被处以50元罚款并当场收缴；拒不改正的，处以200元罚款；有阻碍执法等情形的，处以500元罚款。
条例还规定，禁止吸烟场所的经营者和管理者应当建立禁止吸烟的管理制度，开展控烟宣传教育，并配备控烟检查员。对在禁止吸烟场所吸烟的，场所工作人员应当要求其熄灭点燃的烟草制品；不熄灭的，应当劝其离开；不服从劝阻且不离开该场所的，应当向有关监管部门报告。对于违反此项规定的禁止吸烟场所经营者或者管理者，由卫生行政部门、条例规定的监管部门按照职责范围予以警告，并责令限期改正；逾期不改正的，处以3万元罚款。
不过，有人将新版条例称之为“废话条例”。记者调查发现，不少受访者对办公室禁烟持怀疑态度，“普通员工好说，领导抽烟怎么办？谁敢去举报？”
深圳是中国内地首个进行地方立法控烟的城市，深圳现行控烟条例1998年就出台了，但此前有媒体报道称，“十多年间一张罚单都没有开出”。
