泾县民政局局长胡厚永称，将程朝穆墓穴挖开现场火化，是按照泾县民政局殡葬管理的相关法规来进行的。泾县按规定是火葬区，遗体一律火葬，程朝穆家属不听劝阻，甚至在下达整改通知书后依然没有按照整改通知书的要求执行起尸送殡仪馆火化的措施。民政局最终只能按照安徽的相关规定强制执行。
但记者发现，在2012年修订、2013年1月1日正式发布的国务院殡葬管理条例中，已经废除了“拒不改正的，可以强制执行”的条文。安徽省民政厅社会事务处处长刘洪玉明确表示，安徽泾县强行起尸现场火化的行为，已经违反了2012年修正后的殡葬管理条例。即使强制执行，泾县民政局强制挖开坟墓，现场焚尸的做法也是被严令禁止的。
