新快报讯 近日，湖南公开开庭审理临武县城管执法致瓜农死亡案，4名涉案城管廖卫昌、袁城、骆威平、夏际玉均被控故意伤害获刑。队长廖卫昌犯故意伤害罪被判处有期徒刑11年；袁城、骆威平、夏际玉犯故意伤害罪分别被判处有期徒刑6年、4年、3年6个月。
4被告构成故意伤害罪
据报道，廖卫昌是临武县城管行政执法局执法三大队大队长，袁城、骆威平、夏际玉是协管员。
今年7月17日，临武县城管在执法过程中，与瓜农邓正加夫妇发生冲突，邓正加倒地身亡。尸检结果显示：邓系外力作用诱发脑部畸形血管破裂出血死亡。邓的亲属称，冲突中城管用秤砣砸了邓正加。当地官方还与家属发生“抢尸风波”，一度令冲突升级。事后，身亡瓜农家属获赔89.7万元。
记者从永兴县法院获悉，法院审理认为，7月17日上午，上述4人在行政执法过程中与邓正加夫妇发生争执，因邓正加妻子黄某谩骂行政执法人员，且邓正加用秤杆戳向廖卫昌，4被告便上前对邓正加进行殴打，诱发邓正加小脑与脑干桥延沟交汇处畸形血管破裂，蛛网膜下腔广泛出血而死亡。
法院认为，4被告人的行为均已构成故意伤害罪。
在共同故意伤害犯罪中，廖卫昌、袁城起主要作用，系主犯；骆威平、夏际玉起次要作用，系从犯。
案发后，4被告人主动到公安机关投案，并如实供述自己的罪行，均系自首。
鉴于被害人死亡的直接原因是畸形脑血管破裂致蛛网膜下腔广泛出血死亡，4被告人的伤害行为是导致畸形脑血管破裂的诱因，结合4被告人的自首情节及本案中所起的作用，依法对廖卫昌予以从轻处罚，对其余3人予以减轻处罚。
瓜农家属曾被要求谅解
死亡瓜农的儿子邓青强告诉记者，他们一行5名家属于26日中午到达永兴，由于只拿到3张旁听证，邓青强的母亲和妹妹未能入庭。
庭审后，邓青强说，家人认为判刑过轻，将上诉。
邓青强说，庭审前，曾有城管家属找过他们，让他们签署谅解协议。同时，他们在政府机关工作的亲戚也被县领导谈过话，让亲属做他们的工作。永兴县人民法院的一个庭长也找过他们，希望他们签署谅解协议。
邓青强说：“我们不会原谅他们，只想法律给他们一个公正的审判。”
