Sun Yinghui pointed out that reform must be based on rule of law. 本月举行的中央农村工作会议指出：“要不断探索农村土地集体所有制的有效实现形式，落实集体所有权、稳定农户承包权、放活土地经营权”。
孙英辉说，目前，大量农村劳动力向二三产业转移，农村社会结构深刻变动，农业规模化经营要求土地流转，改变“人均一亩三分地”土地细碎化现象。经营权从土地承包经营权二次分离，是对农村经营主体变化、农地流转等生产力发展要求的适应性调整，有利于农村生产力解放。
截至今年上半年，全国农户承包土地流转面积达到3.1亿亩，已占到家庭承包耕地面积的23.9%，其中近80%是以转包和出租等方式流转。
孙英辉说，二次分离是在农村经济不断发展背景下，适时调整土地产权关系，改善土地资源分配结构的内在要求，是农村生产关系适应生产力发展而产生的变革。
孙英辉强调，任何主体都不能取代农民家庭的土地承包地位。不论承包经营权如何流转，所有权都属于农民集体，承包权都属于农民家庭。
孙英辉说，承包经营权一次分离激活了“人”(农民)的积极性，推动了农村生产力大解放。承包经营权二次分离将激活“物”(农地)的灵活性，促使农村生产力发展再一次飞跃。
孙英辉指出，必须以法治方式推进改革。当务之急是修改农村土地承包法和物权法有关内容，明确承包经营权、承包权和经营权的内容、性质、内涵及法律关系。强化承包经营权二次分离与集体建设用地入市、宅基地赋能等土地产权制度改革的系统性、协同性，确保改革红利最大释放。
国务院已明确由国土资源部统一负责土地、房屋、林地、草原和海域登记，承包经营权登记也将纳入不动产统一登记。中央要求5年内完成农村土地承包经营权确权登记发证。
