废除劳教见证制度文明进步的力量，折射上下互动共同推动法治中国的共识
在2013年即将落幕之时，全国人大常委会通过了关于废止有关劳动教养法律规定的决定。这一存续半个多世纪的制度从今走向终点。这是我国法治建设不断推进中的又一重要举措。
制度的变迁总是与社会的发展相适应，也显示出与时代的“对位关系”。劳教制度的雏形，是1955年针对不够判刑的“反革命分子”等进行的特殊“管理方式”。1957年《国务院关于劳动教养问题的决定》被批准，宣告这一制度的诞生；1979年11月公布的《国务院关于劳动教养的补充规定》，意味其作为一种维护社会治安的措施被启用；1982年国务院转发公安部《劳动教养试行办法》，开启劳教制度普遍化适用阶段。可以说，在50多年的时间跨度内，从诞生、运行及至最后的废止，这一制度都有着它的现实背景和历史意义。
粗略回顾这段历程，不难发现，劳教一直都在寻求自身的合理性，以不断适应社会发展对制度的需求。在功能目的上，从当初的“政治控制”到后来的“治安控制”，再到近年来用于维稳需要，其在实现违法和轻罪行为的矫正上发挥了一定作用，也有利于维护特定时期的治安秩序。
但是，旧制度在寻求合理性的过程中，总会遭遇到一个自身难以突破的极限。当2002年劳动教养适用对象扩大为“十种人”之时，中国的民主法治进程也是轻舟已过万重山，法治意识的增强和权利意识的觉醒，使得实践中大量适用的劳教制度受到挑战。尤其是随着尊重和保障人权入宪，劳教制度日渐显现出缺陷。
劳教制度最终走向消亡，是社会进步的结果，提供给我们一个普遍性的启示则是：与人一样，国家法治的肌体，也需要经常洗洗澡、治治病。如果说当年“收容遣送办法”因孙志刚事件而废止、旧拆迁条例因各种强拆事件而终结，那么此次通过法定途径废止劳教制度，则更接近于主动的清理，意味着公民自由权利再一次得到伸张，宪法的权威和尊严再一次得到维护。
法治首先乃良法之治。一国的法律体系中，宪法是最高法、根本法。正如习近平总书记所说，“保证宪法实施，就是保证人民根本利益的实现。”宪法的有效实施，要求其他法律法规与宪法相违背时，能够得到快速而果断的制止和追究。对此，我国宪法将“监督宪法的实施”职权赋予了全国人大及其常委会，使其有权撤销同宪法和法律相抵触的行政法规。从这个角度看，此次全国人大常委会依职权废止劳教制度，正可感受到宪法实施的脉动。
在法治的长征中，当我们若干年后回望劳教制度的废止时，或许能够清晰感受到这一时刻的历史性意义。废除劳教清除的不仅仅是违宪的旧规范，清洁的也不仅仅是法律制度的肌体健康；在更大的意义上，它见证了制度文明进步的力量，折射出上下互动共同推动法治中国的共识。
