龙岗律师表示，此案涉及外交安全及公共安全，所以无论是外交还是政治层面，美国都是有责任的。本案中，若案犯没有针对人员，只会起诉他纵火罪。纵火罪通常由州法院来量刑，但涉及仇恨、恐怖或外交因素就要升级到联邦法院，可能量刑就会重一些。现在就看该案犯够不够向联邦法院起诉的条件，以及具体会以什么罪名起诉。另外，有可能掌握他仇恨某个团体的证据，但他的行为不一定会符合对仇恨罪的定义，因此有没有强有力的证据也很关键，这关系到起诉能不能成立。
浙江大学刑法学专家高艳东对《环球时报》表示，在美国法律体系下，如果嫌犯认罪，则刑期将相对减轻。如果嫌犯不认罪，就只能等待陪审团的裁决。
