陕西富平贩婴案涉嫌失职人员将择期宣判|陕西|贩婴|失职_新闻资讯

　　今天(1月6日)上午9时，渭南市临渭区人民法院开庭审理与富平县产科医生张淑侠拐卖婴儿有关的事业单位人员涉嫌失职罪一案。在将近五小时的庭审中，法院就公诉机关指控的被告人高文平、司欣、姚军民、王莉四人失职罪一案的犯罪事实、量刑情节和公诉机关出示的证据分别进行了法庭调查和质证，控辩双方进行了充分的辩论。此案将择日宣判。

　　公诉机关认为，上述四名被告人的行为已经触犯了《中华人民共和国刑法》第168条的规定，犯罪事实清楚，证据确实充分，应当以事业单位人员失职罪追究4名被告人的刑事责任。所以依据诉讼法对4名被告人提起了公诉，请求法院依法进行判决。而四名被告人对公诉机关对他们指控的犯罪事实也认为是属实的。

　　在举证和质证阶段，公诉人举出了四部分证据来证明4名被告人有罪。第一个证据，四名被告人主体身份、岗位职责以及妇幼保健医院的制度；第二个证据，证实妇幼保健院制度不健全的证据和被告人履行职责不到位的证据；第三个证据，贩婴案造成了严重后果，使公众对医院丧失公信力的证据；最后一个是综合证据。

　　在辩护人举证阶段，辩护人举出了妇幼保健院产科以及被告人高文平、姚军民所获得的荣誉来为他们进行证据上的辩护。对于公诉人所举的证据法庭对这些证据均予以了确认，而对于辩护人举出的产科及高文平本人获得的荣誉证据，法庭经过和议后不予确认。
