公诉方：四被告犯事业单位人员失职罪
2013年7月16日，陕西富平县薛镇村村民董某在富平县妇幼保健院分娩过程中，被时任该医院产科副主任的医生张淑侠告知“新生婴儿患有先天性传染病及先天残疾”。婴儿家人表示自愿放弃并委托张淑侠处置。随后，婴儿家属质疑婴儿被拐卖，并向富平县公安局城关派出所报案。
据当地警方透露，截至2013年8月9日，公安机关已接到群众报案55起，其中涉及张淑侠的26起。张淑侠等9名犯罪嫌疑人被刑事拘留。2013年9月24日，富平县妇幼保健院原院长王莉因涉嫌事业单位人员失职罪，被富平县公安局取保候审。
代表公诉机关出庭的渭南市临渭区人民检察院检察员张燕认为，被告人王莉、姚军民、高文平、司欣4人，身为国有事业单位工作人员，在工作中严重不负责任，致使张淑侠趁机从医院将多名婴儿抱出拐卖，造成了恶劣的社会影响，致使国家利益遭受重大损失。四被告人的行为已触犯《中华人民共和国刑法》第一百六十八条之规定，犯罪事实清楚，证据确凿充分，应当以事业单位人员失职罪追究四被告人刑事责任。
依据《中华人民共和国刑事诉讼法》第一百七十二条的规定，渭南市临渭区人民检察院于2013年1月6日对被告人高文平、司欣、姚军民、王莉提起公诉。案件由渭南市临渭区人民法院公开审理，法庭将择期宣判。
法庭激辩“失职”罪名
在庭审的过程中，法庭就公诉机关指控的被告人高文平、司欣、姚军民、王莉4人失职罪一案的犯罪事实、量刑情节和公诉机关出示的证据分别进行了法庭调查和质证，控辩双方进行了充分的辩论，辩论核心是4人事业单位人员失职罪是否成立。
辩方律师认为，王莉与姚军民作为医院领导，已经在平时的工作中制定了相关制度并且每周检查，未能及时发现贩婴行为虽然是事实，但并没有刻意隐瞒、回避、逃避相关责任，贩婴案事发后积极作为，王莉和姚军民没有在主观上故意忽视和不负责任，失职罪证据不足，罪名不能成立。
从控辩双方的辩论中可以看出，富平妇幼院平日里管理混乱、人情大于法理的情况已经相当严重。正如贩婴案中主要犯罪嫌疑人张淑侠的供词中所坦言：“如果医院工作人员严格按照规章制度办事，我就不会得逞。”
原富平妇幼院产房临时负责人司欣说，其“负责人”的职务是领导口头上任命的，作为临时负责人，她主要负责排班和医用耗材的领取。医院的规章制度张贴在墙上，有些按照制度办、有些按习惯办，产房交班只是口头交接，在7月份贩婴案出现之后才有签字交接的环节。司欣觉得，张淑侠能够利用职务之便贩卖婴儿，一是医院内部管理不严，二是因为张淑侠是她的领导她盲目轻信了张淑侠，三是她自己没有按照规定办事，没有尽到责任。
富平妇幼院原院长王莉说自己在工作中已经尽力，但有些工作仍旧没有做到位，存在漏洞。王莉供述，对员工教育不够，医院的相关制度执行力度不够，医护人员不能按照相关规定执行，不能及时向上级汇报，分管领导责任心不强，在相关制度的检查和落实不到位，这些都是最后导致贩婴案出现的原因。
公诉机关认为，张淑侠作为医生，能够私自进入病房，直接将婴儿抱走，充分说明医院在产科管理上的混乱，而医院工作人员对工作中存在的漏洞都已经习以为常。医院每周有例行检查，但大多流于形式，未能及时的发现隐患，从而导致“贩婴案”的最终发生。
对管理者问责有利于规定落地执行
这一牵扯医院内部工作人员的贩婴案，暴露出基层医疗系统管理中存在的诸多漏洞。一位办案人员说，4名医院责任人在此次的案件中的失职行为，毫无疑问是张淑侠一而再、再而三“成功贩婴”的推手。如果这些负责人能真正严格落实规定，肩负起自身的管理职责，这些悲剧完全可能避免。
“在涉及新生婴儿方面的医疗卫生系统，实际是由三个层面相互衔接而成，”西北大学法学院副院长曾加说，“国家层面的法律法规、医疗系统内部的相关规定还有专业的妇幼医院自己所制定的制度，这三者相互衔接、合力保证新生儿的健康安全。如果三者衔接出现问题，或者即使是哪一个环节单独出现了问题，都会让这个系统出现纰漏，给不法分子可乘之机。”
曾加认为，对监管者的问责，将震慑那些不认真履行责任的干部，督促整个医疗系统加强管理，有利于相关规定真正落地。
“此外，要想真正杜绝这样的悲剧再次发生，还应该加快医保体系改革，使人人都能享受医疗保障，这样才能从根源上减少弃婴行为。”曾加说。
