本报讯 记者游春亮 广东省深圳市人大常委会近日召开新闻发布会宣布，备受各界关注、被称为史上最严控烟条例的《深圳经济特区控制吸烟条例》经多次审议、修改后通过，将于3月1日起施行。
据介绍，此次修订后的条例共7个章节，包括控烟场所、控烟措施、监督管理等内容。该条例针对原条例内容和形式不足、执法效果不佳等问题进行了全面补充和修正，并制定了很多创设性的规定。
新修订的条例明确了控烟工作原则，实行政府主导、分类管理、场所负责、公众参与、社会监督的原则；加强了政府的组织领导和责任，将控烟工作纳入城市发展规划，作为政府绩效考核的内容，并创新规定了控烟工作联席会议制度，履行审议工作方案、协调解决问题、督查工作开展情况等职责。
同时，新修订的条例将禁止吸烟的场所扩大为所有室内工作场所、室内公共场所、公共交通工具内和部分室外场所，是目前国内城市立法对禁烟场所最全面的规定。新修订的条例还规定了有过渡期的限制吸烟场所，酒吧、歌舞厅等歌舞娱乐场所和茶艺馆、按摩、洗浴等休闲服务场所在2016年12月31日前被列为限制吸烟场所，期满后上述场所将全面禁烟。
在听证阶段，如何执行和监管成为讨论和关注的焦点问题。新修订的条例将原来由卫生部门一家执法调整为以卫生部门为主，交通运输、民航及铁路管理部门、文体旅游、市场监督行政部门、公安部门、城管等多部门齐抓共管的执法模式，充分调动场所主管部门的执法力量。
据了解，1998年11月1日起施行的《深圳经济特区控制吸烟条例》，曾因禁烟10多年却从未开出一张罚单而饱受争议。此次新修订的条例加大了法律责任，同时体现以劝阻、教育为主的执法理念。对违反条例的个人或单位给予改正的机会，个人拒不改正的按情节轻重处以50元、200元、500元的阶梯式处罚，经营管理者拒不改正的最高处以10万元罚款，在提高执法可操作性的同时兼顾法律的阻遏作用。
