  21世纪经济报道记者采访了解到,国务院已要求国土部在2014年6月底前出台《不动产登记条例》。为此,国土部目前正着手起草制定不动产统一登记的法律法规草案和相关规章草稿,除此之外,国土部还部署有关司局准备起草《不动产登记管理办法》,并编制相应技术标准。


  中国房地产及住宅研究会副会长顾云昌认为,不动产登记包括个人住房登记,不动产登记管理办法的出台,可以看作为个人住房信息联网的一项基本制度,有助于减少住建部单方面推进联网的难度。


  一位接近住建部的人士介绍,国土部研讨不动产登记制度时,将借鉴住建部个人住房信息联网的先行经验。


  与此同时,不动产统一登记技术平台的建立还将考虑如何与个人住房信息联网技术标准和管理相协调的问题。


  据上述接近住建部的人士了解,住建部已和国土部就此进行过多次沟通。


  值得一提的是,不动产登记条例制度设计中,将增设查询服务,但将限制在此前的法律法规范围内,备受争议的“以人查房”,或仍为“禁区”,被严格限制。


  重重阻碍


  全国个人住房信息系统联网工作启动已经4年,但进展并不顺利。


  住建部先于2011年要求次年6月底完成60个城市的联网工作,又于2012年要求,在2013年6月底前将完成500个城市的住房信息联网。


  然而,联网大限已至,500个城市的住房信息联网并未完成。一位接近住建部的人士告诉21世纪经济报道记者,联网的城市已经超过60个,但远未达到500个。


  联网进度的延期存在多方原因。顾云昌解释,从技术上看,地方虽然有自己的住房信息系统,但和省里、部里的系统不统一,需要升级;其次,数据不全,有几类住房数据并不在目前的住房系统中,如以前的纸质数据、产权比较复杂的央产房,还有小产权房等。


  与此同时,顾云昌表示,利益集团的阻力也是一大原因。


  一直以来,住房信息联网被社会公众认为“对特定人群的房产信息进行查询以推进反腐败工作”。


  “从技术上,住房信息联网的确可以实现以人查房。”顾云昌表示,然而当前公务员的财产申报制度还没有建立起来,此外,非公务员、私人的财产公布可能产生个人隐私泄露问题,很难推进。


  也正因此,上述接近住建部的人士也介绍,地方为联网设置的阻力不小。据其了解,在已经实现联网的城市中,曾多次出现地方政府不按期同步数据、以迁移属地服务器等理由,切断与住建部前置服务器联网,造成数据不符等情况。


  黑龙江某市的一位分管城建的副市长介绍,早先部署住房信息联网时,部里并未明确联网目的,在登记和录入个人住房信息时,可能涉及到对个人信息的泄密,各方都不大配合,因此,工作很难开展,地方的动力也不大。


  住建部部长姜伟新曾经在一次内部会议上坦承,住房信息联网比预想中要难得多。


  不动产登记为住房信息联网破局


  虽然住房信息联网存在重重阻碍,但是作为楼市长效机制和房产税的基础,住房信息联网势在必行,并在稳步推进中。


  住建部部长姜伟新在日前召开的住建部工作会议上,亦把个人信息联网列入2014年重点工作之一。


  姜伟新要求,2014年进一步扩大联网城市范围,探索建立各省、城市与住房城乡建设部联动的信息系统建设工作及运行机制。


  和此前不一样的是,此次部署并未明确联网的时间进度和数量范围。


  值得一提的是,2014年个人住房信息联网的工作将被纳入到不动产统一登记制度的设计。


  据21世纪经济报道记者采访了解,“不动产登记”的牵头部门——国土部已经开始着手起草制定不动产统一登记的法律法规草案和相关规章草稿。


  除部署工作准备起草《不动产登记管理条例》外,国土部还部署有关司局准备起草《不动产登记管理办法》,并编制相应技术标准。


  国土部的相关人士介绍,不动产登记涉及房屋、土地、林地、草场、海域等多个领域的产权登记整合,按照不动产统一登记制度的设计,个人住房信息系统将与不动产登记统一平台对接。


  这可能涉及到两个方面的问题。上述接近住建部的人士介绍,一是技术标准的统一,即住建部已有的个人住房信息系统联网技术标准,如何与不动产统一登记技术平台的数据库进行统一;二是管理规范统一,即住建部已经下发的“暂行办法”和“登记办法”中涉及到联网问题的有关内容,与未来的“条例”和“办法”如何协调的问题。


  就两系统如何协调的问题,21世纪经济报道记者采访获悉,国土部已经着手与住建部进行沟通,但截至目前,双方并未召开正式会议或形成相关文件性内容。


  以人查房或仍将禁止


  值得一提的是在不动产登记制度起草的前期讨论和研究的准备工作中,涉及到部分“条例”中是否要针对性规定个人不动产信息查询的权限、范围等问题。


  在国土资源部与中编办沟通的增设“不动产登记管理局”的讨论中,涉及到了“不动产登记管理局”未来向社会提供有关查询服务的内容。


  在对外提供查询服务之时,国土部人士介绍,也要确保不动产所有人的各项权利不受侵害。


  “因此在涉及到个人不动产信息查询的权限、范围等问题时,将借鉴并整合住建部全国房地产信息联网系统的先行经验,对以人查房进行规范。”上述国土部人士如是介绍。


  也就是说,不动产统一登记制度建立后提供的查询服务,以特定人为查询条件查询其名下所有房产的“以人查房”,在个人查询领域,或仍为“禁区”。


  21世纪经济报道记者采访了解,为减少联网阻力,确保个人财产信息安全,住建部于2013年内部下发的“暂行办法”,个人住房信息系统全国联网在住建部不设查询端口、住建部不设授权查询权限、查询结果不作为法院判决和行政处罚依据,同时,国家住建部、省、自治区层面也不办理查询业务。


  一直以来,“以人查房”都是个人住房信息联网推进的一大障碍,从2012年四季度开始,郑州房妹、陕西房姐、广东房叔等“丑闻”相继被网民爆出,此后多地均对“以人查房”进行了严格限制。


  上述接近住建部的人士介绍,从技术上来看,以人查房已经没有技术阻碍,但从个人财产信息保护还是减少联网阻力出发,“以人查房都需要禁止”。


  住建部部长姜伟新日前在地方考察时就特别强调,各地要全力推进该系统的建设,不能因其他问题而影响个人住房信息系统建设整体目标的推进。姜伟新也强调,要确保系统的规范管理和安全保密。


  以长沙为例,长沙市房产信息中心负责人在接受记者采访时表示,长沙已于2012年加入了全国房地产信息联网系统,长沙市房产信息中心适时录入长沙地区房地产市场的相关信息,但是暂时还没有接到有关“以人查房”相关内容的通知。
