倒卖：一个手机吉祥号要价10万

四、律师说法：电信号码属于公共资源不应加价销售
昨日，成都商报记者在网上查到了2003年开始施行的《电信网码号资源管理办法》。其中第18条第3款规定，“电信业务经营者取得号码使用权后，未经电信主管部门批准，不得擅自拍卖用户号码资源，不得向用户收取选号费或占用费。”
就此规定，成都商报记者采访了泰和泰律师事务所律师马铃，马铃说，根据这一规定，电信公司就不能收取“选号费”。因为号码资源属于全社会所有，是一种公共资源，电信公司在获取这些号码后不能加价销售。
而腾讯公司自己创造的QQ这样的一种通讯方式，因为其市场需求，具有财产属性。因此，马铃认为，电话号码不能加价销售，而QQ号码可以根据双方的约定进行有偿销售。
