  记者了解到,对不能胜任、坚持教学岗位工作的教师,先实行转岗这一退出渠道,并进行待岗培训,由各级教师管理服务机构指导学校安排进修学习、跟岗培训,给予教师改进和补救的机会。不愿意转岗、待岗培训,或待岗期满仍然不能竞争上岗的,由聘用单位予以解聘。


  为了让退出程序更加透明、正规,《办法》提出,符合校内转岗和待岗培训的,由学校行政会研究后实施,并报教师管理服务机构备案;符合校际转岗或解聘条件的,由学校行政会研究后,报教师管理服务机构审核,并经同级教育行政部门审批后实施,学校提供事实依据和说明。

  一位区教育局人事科科长认为,对于退出机制,“必须要较真,不然学校哪有那么多后勤岗位让你转?”在这位科长看来,学校除了要舍得下人情脸面,退出机制的管理也要到位。她告诉记者,曾经查到一位老师伪造医院假条,长期请病假不到岗,教育局决定将其解聘。“老师肯定不乐意,如果没把证据拿实拿准,这个时候就很难处理。”她说,好在当时证据确凿,这位老师最后提出能否改为辞聘,免得在档案上留下不好的一笔。


  记者从市教育局了解到,为解决退出渠道的合法性问题,降低争议处理的诉讼风险,成都市在《办法》中首次提出“合同退出机制”,将教师退出教学岗位的相应条款和内容格式化为合同内容。

  更重要的是,教师资格考试合格证明不再终身有效。目前省内一旦通过考试,拿到“教师资格考试合格证明”就被认定终身合格。此次《办法》也堵死了这一漏洞,并为“教师资格考试合格证明”设定了3年的有效期。这意味着,拿到该证3年以上后,想要再去当地教育部门认证当老师还得重新再考试。此外,师范生不再毕业就能拿教师资格证,后年开始也必须参加全国统考;已当老师的教师资格证也必须每5年一审,彻底打破教师的“铁饭碗”。


  不过,目前《中小学教师资格考试暂行办法》还只适用于试点省份,但后年这一文件就将对四川生效。
