检方出示两份新证据 其中一份证实商人汇给其子100万澳元 被告人苏顺虎没有提出异议
继2013年9月4日开庭后，今日上午，原铁道部运输局副局长兼营运部主任苏顺虎涉嫌受贿2490余万元一案再次在市二中院开庭。在法庭上，检方出示两份新证据，苏顺虎没有异议。
首次开庭 检方指控受贿2490余万
苏顺虎历任铁道部运输局货运计划处副处长、铁道部运输局营运部货运营销计划处处长、昆明铁路局副局长。其后苏顺虎在沈阳铁路局工作期间，因工作表现出色，同时又与刘志军是同乡，渐渐被刘志军注意到。
苏顺虎所涉及指控，都与铁路货运有关。
第一次开庭时，检方指控，2003年至2011年间，苏顺虎利用职务便利，接受山西曲沃县闵光焦化有限责任公司等三家单位请托，帮其解决煤炭运输、货物运输等问题，收受上述单位负责人给予的款物折合人民币2490余万元。案发后，大部分受贿款物已追缴。

收受江西省物资贸易有限责任公司法定代表人周云富给予款物折合人民币1194万余元
收受北京铁润商贸有限责任公司法定代表人段莉给予款物折合人民币1212万余元。
受审认罪对受贿数额提异议
58岁的苏顺虎穿着号服被法警带进法庭时，在场的人看到，头发花白的他比被羁押之前略显苍老，身材瘦小。回答问题时，他声音不大。
进入法庭调查阶段后，庭审大部分时间都是公诉人在举证，证据主要包括证明苏顺虎的主体身份的证据，包括任免通知及履历表，以及在侦查阶段被告人的供述，行贿人、被告人妻子、亲属的证言，以及一些铁路系统工作人员的证言。
苏顺虎当庭表示认罪。对于指控，他说得最多的就是“没意见”。苏顺虎称，他主要是通过批示文件、打电话、打招呼等方式，帮助行贿人解决煤炭或货物运输的问题。
公诉人指出，苏顺虎负责全国铁路运输编制和货运分配，作为货运系统的最高领导，他打招呼十分有用。苏顺虎受贿有主观故意，且很多金钱是在孩子结婚、相互拜访的掩护下收受的。但鉴于苏顺虎归案后能配合办案，且大部分赃款已经追回，可以依法从轻处罚。
流泪忏悔请求法院从轻处理
据了解，1976年，22岁的铁道兵苏顺虎经推荐，就读于兰州铁道学院铁道运输专业；2003年，他从北京大学工商管理专业硕士班毕业；2007年7月，其在中南大学物流工程专业博士在读。
庭审最后阶段，苏顺虎声泪俱下地表达了忏悔之情。他说，他生于一个贫苦的家庭，上小学的学具是靠自己捡破烂卖钱获得的。上高中时，为了不增加家庭负担，从来没在学校食堂吃过饭，只吃粮食和从家里带来的咸菜……
苏顺虎哭着说，他一步步走到领导岗位，却在“晚年放松学习，走上了犯罪道路”，他对不起党、国家、人民及同事和家人，请求法院从轻处理，并称判决后不会上诉，给他重新做人的机会。
他表示将服从判决不上诉，哪怕砸锅卖铁、倾家荡产也会退清全部赃款，决不食言。
今日现场 检方出示两份新证据苏顺虎没有异议
上午10时，身穿橘色和灰色相间号服的苏顺虎被带进二中院第三法庭，相比4个月前第一次受审，苏顺虎又消瘦了一些。苏顺虎的2名亲属也到庭旁听。
上次开庭时，检方指控苏顺虎收受江西省物资贸易有限责任公司法定代表人周云富钱款1194万余元。其中有一笔是周云富以给苏顺虎在澳洲留学的儿子留学费用等名义给付的100万澳元。
苏顺虎的辩护人对汇款金额和收款人英文姓名提出异议，认为涉外证据取证程序存在瑕疵。
今天在法庭上，检方出具了一份周云富的书证。周云富称，钱是从香港汇过去的，金额为100万澳元，收款人是苏顺虎的儿子。
辩护人表示，收款人的名字是英文的，没有证据证明该英文收款人就是苏顺虎的儿子。而检方此前指控苏顺虎收受金额超过100万澳元，与指控金额明显不符。
“虽然账号是苏顺虎提供的，但检方没有证据证明收款人的英文名字和苏顺虎儿子是同一个人。办案人员工作态度不严谨，除了苏顺虎的供述外，还应有其他证据佐证，检方不能主观推断这笔钱就是给了苏顺虎，因此我们认为此项指控事实不清，证据不足。”辩护人说。
法官问苏顺虎对此证据的意见时，苏顺虎低头想了想，表示没有异议。
检方提出的第二份新证据，是有关对苏顺虎位于太阳宫附近的一套房屋予以查封。苏顺虎表示没有异议。
在庭审结束苏顺虎离开法庭时，他的亲属告诉他，他的妻子孩子都很好，让他不要担心，苏顺虎点点头走出法庭。
其妻涉案目前等待宣判
据了解，检方对苏顺虎的3起指控，均将其妻叶晓毛牵扯进来。叶晓毛是湖北人，初中文化，原铁道部行管局机关服务中心退休干部。
2011年6月，苏顺虎被有关部门控制后，叶晓毛也因涉嫌受贿罪被警方监视居住，3个月后被取保候审。检方起诉时，叶晓毛的罪名由受贿罪变更为掩饰、隐瞒犯罪所得罪。
据指控，叶晓毛于2004年至2011年间，明知张邦才、段莉、周云富等人给予其丈夫苏顺虎的款物系犯罪所得，仍予以掩饰、隐瞒款物折合人民币共计1300余万元。检方认为，应当以掩饰、隐瞒犯罪所得罪追究叶晓毛的刑事责任。
据悉，叶晓毛一案已经开过庭，目前正在等待宣判。
庭前采访 律师：苏顺虎被调查之初主动认罪
据苏顺虎的律师介绍，苏顺虎从被调查开始至庭审，态度一直很好。
被抓时，苏顺虎交代了办案人员并不完全掌握的犯罪事实，而且始终表示积极退赔，目前退赔金额还差700多万元，但是苏顺虎的一套房产已经被法院查封，如果拍卖掉，足可以弥补剩余款项。
另据知情人介绍，向苏顺虎行贿的北京铁润商贸有限责任公司法定代表人段莉在找苏顺虎帮忙前曾经跟铁路部门签订过运输合同，但是很多货物都没有按期运出去，所以段莉找到苏顺虎要求帮忙。
该人称，铁路系统的货运与其他航空等行业不同，就算签订了运输合同，也不一定能兑现。也就是说，如果铁路部门没有在一定时间内将货物运到指定地点，铁路部门将不承担任何赔偿责任。
“段莉就是在陪苏顺虎遛弯时，提出向其行贿，并提出自己的要求的。”该知情人说。
另据了解，苏顺虎是铁道部窝案中出现负面新闻最少的。苏顺虎的生活很有规律，就是上班下班，极少吃请，晚上都是在家吃饭，但是苏顺虎晚饭后一定要散步，在家周围遛弯。
