苏顺虎对检方新证无异议
昨天上午10时许，身穿号服的苏顺虎被法警带进市二中院第三法庭，头发花白的他比上次开庭显得更加苍老和消瘦。
58岁的苏顺虎案发前是原铁道部运输局副局长兼营运部主任，曾任铁道部运输局营运部货运营销计划处处长、营运部副主任。
2013年9月4日，此案第一次开庭时，检方指控苏顺虎于2003年至2011年间，利用职务便利，先后接受请托为三家公司解决煤炭、货物运输等问题提供帮助，分别收受山西曲沃县闵光焦化有限责任公司董事长张邦才给予的钱款85万余元；江西省物资贸易有限责任公司法定代表人周云富给予的款物1194万余元；北京铁润商贸有限责任公司法定代表人段莉给予的款物1212万余元。以上共计折合人民币2490余万元。
昨天，检方补充了两份新证据，一份证明原铁道部是行政单位，另一份是周云富的情况说明，证明他曾从香港向苏顺虎在澳洲留学的儿子汇款100万澳元作为留学费用。辩方当庭对这份证据的数额提出异议，并认为收款人是英文姓名，不能证明就是苏顺虎的儿子，涉外证据取证程序存在瑕疵。
苏顺虎则对这两份证据没有异议。法庭还宣读了苏顺虎位于太阳宫的房产已被查封的情况，他也没有异议。
昨天的庭审程序仅持续了10分钟左右。苏顺虎被带离法庭时，旁听席上的家属告诉他，他的妻子、孩子都很好，让他放心，苏顺虎点点头，随后迅速被带出法庭。
■亲属涉案
妻子涉罪取保候审等待宣判
据了解，苏顺虎案发后，将其妻子叶晓毛也牵扯进来。现年57岁的叶晓毛与苏顺虎是老乡，湖北人，初中文化程度，原铁道部行管局机关服务中心退休干部。
2011年6月，苏顺虎被有关部门控制后，叶晓毛也因涉嫌受贿罪被警方监视居住，3个月后被取保候审。检方起诉时，叶晓毛的罪名由受贿罪变更为掩饰、隐瞒犯罪所得罪。
检方指控，叶晓毛于2004年至2011年间，明知张邦才、段莉、周云富等人给予其丈夫苏顺虎的款物系犯罪所得，仍予以掩饰、隐瞒款物折合人民币共计1300余万元。检方认为，应当以掩饰、隐瞒犯罪所得罪追究叶晓毛的刑事责任。
据悉，叶晓毛案已经开过庭，目前她处于取保候审中，由于房产已被查封，只能借住亲戚家，等待法院判决。
■律师披露
拍卖查封房产钱款足够退赔
据苏顺虎的辩护律师介绍，苏顺虎从被调查开始直至庭审，态度一直很好。被抓后，苏顺虎主动交代了办案人员并不完全掌握的犯罪事实，而且始终表示积极退赔，目前退赔金额还差几百万元，被法院查封的房屋如果拍卖，足够退赔。
检方在开庭时也提到，苏顺虎如实供述，主动交代侦查机关尚未掌握的犯罪事实，且本案大部分受贿款物已追缴，建议对其从轻处罚。
第一次开庭时，苏顺虎表示认罪。在做最后陈述时，他曾声泪俱下地表达了忏悔之情。他说，他生于一个贫苦的农民家庭，上小学的学习用具都是靠自己捡破烂卖钱获得的。上高中时，为了不增加家庭负担，他从来没在学校食堂吃过饭，都从家里带粮食和咸菜。
苏顺虎哭着说，他一步步走到领导岗位，却在晚年放松学习，走上了犯罪道路，对不起党、国家、人民，也对不起同事和家人，“一失足成千古恨”。
他请求法院轻判，表示将服从判决不上诉，“哪怕砸锅卖铁、倾家荡产也会退清全部赃款，决不食言”。
