一、为推动政府职能转变提供法治保障

二是严格控制新设行政许可。为了巩固行政审批制度成果，遏制行政审批边减边增、明减暗增，在总结多年来中央和地方行政审批制度改革的做法和经验基础上，国务院于2013年9月发布关于严格控制新设行政许可的通知。通知要求，今后起草法律草案、行政法规草案一般不新设行政许可；从保障企业和个人投资自主权、放宽市场准入、降低企业和个人的投资创业门槛等方面，明确了不得新设行政许可的十六种具体情形，除法律、行政法规规定外，行政许可一律不得收费；确需新设的，必须严格遵守行政许可法的规定，严格设定标准。
三是推动注册资本登记制度改革。2013年10月，国务院常务会议审议通过注册资本登记制度改革方案，决定放宽注册资本登记条件，将公司注册资本实缴登记制改为认缴登记制，取消公司注册资本最低限额，放松市场主体的准入管制，以进一步优化营商环境，降低创业成本，激发社会投资活力和创造力。国务院及时向全国人大常委会提交了有关议案，对公司法有关条款进行修改。
二、突出政府立法重点，用法治方式履行政府职能、推动改革发展
一是深化改革开放。为了加快政府职能转变，创新对外开放模式，进一步探索深化改革开放的经验，向全国人大常委会提请审议全国人大常委会关于授权国务院在中国(上海)自由贸易试验区等国务院决定的特殊区域内暂时停止实施有关法律规定的决定(草案)，公布国务院关于在中国(上海)自由贸易试验区内暂时调整有关行政法规和国务院文件规定的行政审批或者准入特别管理措施的决定。为了促进对外开放和对外交往，规范外国人入境出境管理工作，制定外国人入境出境管理条例。为了便于外资保险公司在中国境内开展经营活动，修订外资保险公司管理条例。为了加强铁路安全管理，保障铁路运输安全畅通，适应铁路政企分开要求，制定铁路安全管理条例。为了完善国际收支统计申报制度，适应国际收支统计实践发展，修订国际收支统计申报办法。
二是保障和改善民生。建立健全社会救助制度，以法治方式织牢保障困难群众基本生活的安全网。为了落实十八届三中全会精神，稳妥扎实有序推进调整完善生育政策，向全国人大常委会提出关于调整完善生育政策的决议草案。
三是推进生态文明建设。为了加强城镇排水与污水处理活动管理，保障城镇排水与污水处理设施安全运行，防治城镇水污染和内涝灾害，保障人民生命财产安全和公共安全，制定城镇排水与污水处理条例。为了防治畜禽养殖污染，促进畜禽养殖废弃物综合利用，保护和改善环境，保障人体健康，制定畜禽规模养殖污染防治条例。
四是维护国家安全。为了加强长江三峡水利枢纽安全保卫工作，维护三峡运行安全和秩序，制定长江三峡水利枢纽安全保卫条例。为了保护军事设施安全，保障军事设施使用效能和军事活动正常进行，加强国防现代化建设，提请审议军事设施保护法修正案(草案)。
三、扎实推进依法行政各项工作

二是行政复议工作稳步推进。国务院行政复议工作既注重依法办案、公正裁决，树立国务院依法行政的权威和形象，又注重依法有效化解矛盾纠纷，努力实现“定纷止争、案结事了”。全年办结立案受理的案件161件，裁决维持48件，因申请人撤回申请终止23件，确认违法9件，驳回申请81件。积极配合全国人大常委会开展行政复议法执法检查，认真做好行政复议法实施情况汇报。进一步梳理行政复议法实施中存在的主要问题，明确行政复议法修订的主要思路和内容。加大指导监督力度，推动行政复议工作均衡发展。
