  【1问】 延长理由如何服众?


  山东省政府日前发布消息,将延长泰莱高速莱城区与莱新高速连接线等6段高速公路收费期限;菏泽至东明等7段高速公路、济南至聊城等2段高速公路收费期限届满,暂时延长收费期限1年。


  我国收费公路管理条例规定,政府还贷公路的收费期限,最长不得超过15年。


  据了解,当地部门给出的收费理由是,一是贷款没还清,还有巨额的养护费;二是等待新政策,看国家是否有长期收费政策出台;三是个别路段免费会影响高速公路“整体性和完整性”;四是免费后不好管理。


  近年来,任意设置高速公路收费期限的情况颇为多见。1987年开始收费的京石高速,收费年限到2029年,长达42年。而北京市审计局的一份报告显示,京石高速公路北京段,截至2004年12月已累计收费17亿多元,偿还贷款等款项后还剩余6亿元左右。此外,首都机场高速、沪宁高速、沪杭高速等公路的收费期限均超过30年。


  “‘最长不得超过15年’的规定没有任何前置条件,没有任何例外情形,‘钱没还完,下面还有巨额养护费’并不能成为延期收费的理由,未还清的贷款以及养护费应由政府财政埋单,这是公路的公益属性决定的,也是政府应当承担的责任。”湖北金卫律师事务所执行主任宫步坦说,山东地方政府随意延长高速公路收费期限,明显涉嫌违规。


  【2问】 超期收费只为敛财?

  “高速公路上市公司的丰厚利润加上15年的收费,为建设单位还贷提供了重要保障。”中国消费者协会律师团团长邱宝昌表示,一些地方政府把高速公路的承包权、经营权转让给企业,增加收费年限,是为了保护地方政府和企业的既得利益。这样一来,等于企业与地方政府“合谋”,将高速公路当成了敛财工具。


  十二届全国政协委员孙继业反映,一些地方“政府还贷公路”变身为“经营性公路”,收费期限随意提高,于是高速公路成了地方政府及相关企业的“提款机”。
